PAG LIN 1 1 Section 1. APPROPRIATIONS FOR TEMPORARY UTILITY BOARD 1 2 STAFFING. 1 3 1. The utilities board may employ additional temporary 1 4 staff, or may contract for professional services with persons 1 5 who are not state employees, as the board deems necessary to 1 6 review power purchase contracts pursuant to 2001 Iowa Acts, 1 7 House File 577, if enacted. Beginning July 1, 2001, there is 1 8 appropriated out of any funds in the state treasury not 1 9 otherwise appropriated, such sums as may be necessary to 1 10 enable the board to hire additional staff and contract for 1 11 services under this subsection. The costs of the additional 1 12 staff and services shall be assessed to the utilities pursuant 1 13 to the procedure in section 476.10. 1 14 2. The utilities board may employ additional temporary 1 15 staff, or may contract for professional services with persons 1 16 who are not state employees, as the board deems necessary to 1 17 complete the report on electric energy policy issues required 1 18 by 2001 Iowa Acts, House File 577, if enacted. Beginning July 1 19 1, 2001, and ending January 31, 2002, there is appropriated 1 20 out of any funds in the state treasury not otherwise 1 21 appropriated, such sums as may be necessary to enable the 1 22 board to hire additional staff and contract for services under 1 23 this subsection. The costs of the additional staff and 1 24 service shall be assessed to the utilities pursuant to the 1 25 procedure in section 476.10. 1 26 EXPLANATION 1 27 This bill provides appropriations for additional temporary 1 28 staffing for the Iowa utilities board, prior to assessment of 1 29 those expenses to the utilities pursuant to the process in 1 30 Code section 476.10. 1 31 House File 577 provides for contested case proceedings 1 32 related to power purchase contracts filed by public utilities, 1 33 that, if approved by the board, would be included in the 1 34 public utility's regulated retail rates. 1 35 House File 577 also requires the Iowa utilities board to 2 1 prepare a report for the general assembly by January 21, 2002, 2 2 regarding the actions the board recommends be taken to 2 3 implement the intent of the general assembly as stated in 2 4 House File 577, to attract the development of electric power 2 5 generating and transmission facilities within the state in 2 6 sufficient quantity to ensure reliable electric service to 2 7 Iowa consumers and provide economic benefits to the state, 2 8 assessing at least the following topics: (1) the need for 2 9 incentives; (2) the need for assurances of cost recovery; (3) 2 10 the need for new generation and transmission facilities, and 2 11 for power purchase contracts; (4) the need for competitive 2 12 bidding for new generation and transmission facilities; (5) 2 13 power purchase contracts; (6) generation capacity in Iowa and 2 14 the possibility of exportation of energy, including the issue 2 15 of long-term and peak power purchases; (7) evaluation of 2 16 Iowa's transmission system and its connection to the regional 2 17 power grid; (8) municipal generation, transmission, financing, 2 18 and other related issues; (9) generation capacity and 2 19 transmission facilities of rural electric cooperatives; (10) 2 20 renewable energy sources, including but not limited to wind 2 21 and corn-related power sources; and (11) the appropriateness 2 22 and desirability of requiring the municipal utilities and the 2 23 rural electric cooperatives to file in the future multiyear 2 24 plans and budgets for managing regulated emissions from their 2 25 electric power generating facilities fueled by coal and 2 26 located in this state, similar to the process required for 2 27 rate-regulated public utilities under Code section 476.6, 2 28 subsection 16B, as contained in House File 577. 2 29 Code section 476.10, as amended by Senate File 279, 2001 2 30 Iowa Acts, which was signed by the governor and became 2 31 effective on March 14, 2001, provides for a process of direct 2 32 and remainder assessments to utilities of the costs incurred 2 33 by the Iowa utilities board. 2 34 LSB 3536YC 79 2 35 jj/gg/8
