  1  1    Section 1.  NEW SECTION.  317.27  WEED-FREE CERTIFICATION
  1  2 PROGRAM.
  1  3    1.  The board of supervisors for a county that has
  1  4 appointed a county weed commissioner may adopt an ordinance
  1  5 providing for a weed-free certification program for forage or
  1  6 mulch as provided in this section.  The purposes of the
  1  7 program are to limit the spread of noxious seeds, noxious
  1  8 weeds, and undesirable plants and to increase markets for
  1  9 weed-free forage or mulch.
  1 10    2.  An ordinance adopted by a county board of supervisors
  1 11 and any related policy adopted by a county weed commissioner
  1 12 shall conform with rules which shall be adopted by the state
  1 13 weed commissioner.  The state weed commissioner shall adopt
  1 14 rules listing, noxious weed seeds, noxious weeds and
  1 15 undesirable plants; establishing management and treatment
  1 16 practices; and establishing inspection procedures; and
  1 17 providing for documentation related to certification,
  1 18 including transit forms, markings, or tags.  The list shall at
  1 19 least include primary and noxious weed seeds as defined in
  1 20 section 199.1 and primary and secondary noxious weeds as
  1 21 defined in section 317.1A.  The department may publish the
  1 22 forms or set forth requirements for such forms to be published
  1 23 by the county weed commissioner.  The rules may also require
  1 24 that county weed commissioners attend continuing education
  1 25 courses in order to administer the program.  The rules shall
  1 26 to every extent practicable be based on programs administered
  1 27 in other states, requirements of federal agencies as provided
  1 28 in section 7 U.S.C. } 2814, and recommendations of interested
  1 29 organizations proposing regional forage certification
  1 30 standards.
  1 31    3.  The state weed commissioner, in cooperation with Iowa
  1 32 state university, other state or federal agencies, or
  1 33 interested organizations, may conduct continuing educational
  1 34 courses for county weed commissioners as required in order to
  1 35 administer this section.
  2  1    4.  For the purpose of obtaining revenue to defray the
  2  2 costs of administering the provisions of this section, the
  2  3 county board of supervisors may establish fees required for
  2  4 certification, and the department of agriculture and land
  2  5 stewardship and Iowa state university may establish fees for
  2  6 conducting continuing education courses.  All moneys received
  2  7 by the department or Iowa state university shall be handled in
  2  8 the same manner as repayment receipts, as defined in section
  2  9 8.2, and shall be used solely for the administration and
  2 10 enforcement of this section.  
  2 11                           EXPLANATION
  2 12    This bill provides for a weed-free certification program
  2 13 for forage or mulch.  A board of supervisors for a county that
  2 14 has appointed a county weed commissioner may adopt an
  2 15 ordinance providing for the program.  The department of
  2 16 agriculture and land stewardship (and specifically the state
  2 17 weed commissioner) must adopt rules listing noxious weed
  2 18 seeds, noxious weeds and undesirable plants; establishing
  2 19 management and treatment practices; and establishing
  2 20 inspection procedures; and documentation related to
  2 21 certification.  The rules may also require that county weed
  2 22 commissioners attend continuing education courses.  The rules
  2 23 shall to every extent practicable be based on programs

  2 26 The bill provides that the county board of supervisors may
