  1  1    Section 1.  Section 28.7, subsection 1, paragraph a, Code
  1  2 2001, is amended to read as follows:
  1  3    a.  Designate a public agency of this state, as defined in
  1  4 section 28E.2, a community action agency as defined in section
  1  5 216A.91, an area education agency established under section
  1  6 273.2, or a nonprofit corporation, to be the fiscal agent for
  1  7 grant moneys and for other moneys administered by the
  1  8 community board.
  1  9    Sec. 2.  Section 28.7, Code 2001, is amended by adding the
  1 10 following new subsection:
  1 11    NEW SUBSECTION.  3.  The following funding streams shall be
  1 12 administered by designated community empowerment area boards
  1 13 commencing in the indicated fiscal year:
  1 14    a.  Commencing with the fiscal year beginning July 1, 2001,
  1 15 child abuse prevention grant funding disbursed through the
  1 16 department of human services.
  1 17    b.  Commencing with the fiscal year beginning July 1, 2001,
  1 18 pregnancy prevention grant funding disbursed through the
  1 19 department of human services.
  1 20    Sec. 3.  GRANT DISTRIBUTION DIRECTIVE.  If an appropriation
  1 21 of at least seventeen million nine hundred thousand dollars is
  1 22 enacted for the fiscal year beginning July 1, 2001, for
  1 23 deposit in the school ready children grants account of the
  1 24 Iowa empowerment fund created in section 28.9, the Iowa
  1 25 empowerment board shall authorize distribution of school ready
  1 26 children grants to designated community empowerment areas in
  1 27 accordance with this section.  Those designated community
  1 28 empowerment areas that first received a school ready grant in
  1 29 fiscal year 2000-2001, shall be eligible to receive the school
  1 30 ready children grant amounts provided to those areas in that
  1 31 fiscal year, as annualized for a full fiscal year.  All other
  1 32 designated community empowerment areas are eligible to receive
  1 33 a school ready children grant in the same amount as the areas
  1 34 received in fiscal year 2000-2001.  In order for the community
  1 35 empowerment areas to receive the grant for which the areas are
  2  1 eligible, the community empowerment area board must submit a
  2  2 written plan amendment extending by one year the area's
  2  3 comprehensive school ready children grant plan developed for
  2  4 providing services for children from birth through five years
  2  5 of age and provide other information specified by the Iowa
  2  6 empowerment board.  The amendment may also provide for changes
  2  7 in the programs and services provided under the plan.  The
  2  8 Iowa empowerment board shall establish a submission deadline
  2  9 for the plan amendment that allows a reasonable period of time
  2 10 for preparation of the plan amendment and for review and
  2 11 approval or request for modification of the plan amendment by
  2 12 the Iowa empowerment board.  In addition, the community
  2 13 empowerment board must continue to comply with reporting
  2 14 provisions and other requirements adopted by the Iowa
  2 15 empowerment board in implementing section 28.8.
  2 16    Sec. 4.  EFFECTIVE DATE.  This Act, being deemed of
  2 17 immediate importance, takes effect upon enactment.  
  2 18                           EXPLANATION
  2 19    This bill relates to Iowa's community empowerment
  2 20 initiative.
  2 21    The bill amends Code section 28.7 to authorize an area
  2 22 education agency to serve as fiscal agent for a community
  2 23 empowerment area board.
  2 24    Code section 28.7, relating to community empowerment area
  2 25 board duties and responsibilities, is amended to provide that
  2 26 commencing with the fiscal year beginning July 1, 2001, the
  2 27 area boards are to administer child abuse prevention and
  2 28 pregnancy prevention grant funding that is disbursed through
  2 29 the department of human services.
  2 30    The bill provides a directive to the Iowa empowerment board
  2 31 in the event at least $17.9 million is appropriated for
  2 32 deposit in the school ready children grants account of the
  2 33 Iowa empowerment fund for fiscal year 2001-2002.  Community
  2 34 empowerment areas that first received a grant in fiscal year
  2 35 2000-2001 are eligible to receive the same amount as that
  3  1 first grant, as annualized for a full year of funding.  All
  3  2 other community empowerment areas are eligible to receive the
  3  3 same grant amount as the areas received in fiscal year 2000-
  3  4 2001.  In order to receive the amount for which an area is
  3  5 eligible, the area's board must submit a written amendment for
  3  6 a one-year extension to the area's plan for the grant funding.
  3  7 The amendment may provide for changes in the programs and
  3  8 services provided under the plan.  The Iowa empowerment board
  3  9 is required to develop a submission deadline for a plan
  3 10 amendment that allows reasonable time for preparation of the
  3 11 plan amendment and for the amendment's review and approval or
  3 12 request for modification by the Iowa empowerment board.
  3 13    The bill takes effect upon enactment.
