  1  1    Section 1.  Section 135B.7, unnumbered paragraph 2, Code
  1  2 2001, is amended to read as follows:
  1  3    The rules shall state that a hospital shall not deny
  1  4 clinical privileges to physicians and surgeons, podiatric
  1  5 physicians, osteopaths, osteopathic surgeons, chiropractors,
  1  6 dentists, certified health service providers in psychology,
  1  7 physician assistants, or advanced registered nurse
  1  8 practitioners licensed under chapter 148, 148C, 149, 150,
  1  9 150A, 151, 152, or 153, or section 154B.7, solely by reason of
  1 10 the license held by the practitioner or solely by reason of
  1 11 the school or institution in which the practitioner received
  1 12 medical schooling or postgraduate training if the medical
  1 13 schooling or postgraduate training was accredited by an
  1 14 organization recognized by the council on postsecondary
  1 15 accreditation or an accrediting group recognized by the United
  1 16 States department of education.  A hospital may establish
  1 17 procedures for interaction between a patient and a
  1 18 practitioner.  The rules shall not prohibit a hospital from
  1 19 limiting, restricting, or revoking clinical privileges of a
  1 20 practitioner for violation of hospital rules, regulations, or
  1 21 procedures established under this paragraph, when applied in
  1 22 good faith and in a nondiscriminatory manner.  This paragraph
  1 23 shall not require a hospital to expand the hospital's current
  1 24 scope of service delivery solely to offer the services of a
  1 25 class of providers not currently providing services at the
  1 26 hospital.  This section shall not be construed to require a
  1 27 hospital to establish rules which are inconsistent with the
  1 28 scope of practice established for licensure of practitioners
  1 29 to whom this paragraph applies.  This section shall not be
  1 30 construed to authorize the denial of clinical privileges to a
  1 31 practitioner or class of practitioners solely because a
  1 32 hospital has as employees of the hospital identically licensed
  1 33 practitioners providing the same or similar services.  
  1 34                           EXPLANATION
  1 35    This bill provides for the addition of chiropractors to the
  2  1 list of licensed practitioners to whom a hospital cannot deny
  2  2 clinical privileges under specified circumstances.  Code
  2  3 section 135B.7 provides that clinical privileges for
  2  4 designated licensed practitioners shall not be denied solely
  2  5 by reason of the license held by the practitioner or the
  2  6 school or institution in which the practitioner received
  2  7 medical schooling or postgraduate training, if the medical
  2  8 schooling or postgraduate training was accredited by an
  2  9 organization recognized by the council on postsecondary
  2 10 accreditation or an accrediting group recognized by the United
  2 11 States department of education.
