  1  1    Section 1.  Section 279.3, unnumbered paragraph 1, Code
  1  2 2001, is amended to read as follows:
  1  3    At a regular or special meeting of the board held in July
  1  4 or August prior to or on August 15 the regular school
  1  5 election, the board shall appoint a secretary who shall not be
  1  6 a teacher employed by the board but may be another employee of
  1  7 the board.  The board shall also appoint a treasurer who may
  1  8 be another employee of the board.  However, the board may
  1  9 appoint one person to serve as the secretary and the
  1 10 treasurer.
  1 11    Sec. 2.  Section 279.33, Code 2001, is amended to read as
  1 12 follows:
  1 13    279.33  ANNUAL SETTLEMENTS.
  1 14    At a regular or special meeting held not later than August
  1 15 15 prior to the regular school election, the board of each
  1 16 school corporation shall meet, examine the books of and settle
  1 17 with the secretary and treasurer for the year ending on the
  1 18 preceding June 30, and transact other business as necessary.
  1 19 The treasurer at the time of settlement shall furnish the
  1 20 board with a sworn statement from each depository showing the
  1 21 balance then on deposit in the depository.  If the secretary
  1 22 or treasurer fail to make proper reports for the settlement,
  1 23 the board shall take action to obtain the balance information.  
  1 24                           EXPLANATION
  1 25    This bill strikes language that requires that the board of
  1 26 directors of a school district appoint a secretary and
  1 27 treasurer and settle the books for the previous fiscal year by
  1 28 August 15.  However, the language is replaced with the
  1 29 requirement that the school board appoint the secretary and
  1 30 treasurer and settle the previous year's books at a regular or
  1 31 special meeting held prior to the regular school election.
