PAG LIN 1 1 Section 1. Section 216.15B, Code 2001, is amended to read 1 2 as follows: 1 3 216.15B MEDIATION – CONFIDENTIALITY. 1 4 1. A mediatorshallmay be designated in writing by the 1 5 commission to conduct formal mediation of a complaint filed 1 6 under this chapter. The written designation must specifically 1 7 refer to this section. 1 8 2. If formal mediation is conducted by a mediator pursuant 1 9 to this section, the confidentiality of all mediation 1 10 communications and mediation documents is protected as 1 11 provided in section 679C.2. 1 12 EXPLANATION 1 13 This bill amends mediation language in the civil rights Act 1 14 to provide that formal mediation is not a mandatory step for 1 15 every complaint filed with the Iowa civil rights commission. 1 16 The bill further provides that a mediator may be designated 1 17 in writing by the commission to conduct formal mediation of a 1 18 complaint filed with the commission, in contrast to other 1 19 informal mediation processes contained within the Iowa civil 1 20 rights Act. Once this designation is made, certain 1 21 confidentiality provisions and privileges apply. These 1 22 changes are consistent with the provisions of Code chapter 1 23 679C enacted in 1998. 1 24 LSB 1045DP 79 1 25 rh/cls/14
