PAG LIN 1 1 Section 1. Section 372.4, unnumbered paragraph 3, Code 1 2 2001, is amended to read as follows: 1 3 The mayor shall appoint a council member as mayor pro tem, 1 4 and shall appoint and dismiss the marshal or chief of police 1 5 except where an intergovernmental agreement makes other 1 6 provisions for police protection or as otherwise provided in 1 7 section 400.13. However, the appointment and dismissal of the 1 8 marshal or chief of police are subject to the consent of a 1 9 majority of the council. Other officers must be selected as 1 10 directed by the council. The mayor is not a member of the 1 11 council andmayshall not vote as a member of the council. 1 12 EXPLANATION 1 13 This bill provides that the marshal or chief of police of a 1 14 city with a mayor-council form of government, and without 1 15 civil service or an intergovernmental agreement providing 1 16 another method of selection, shall be appointed and dismissed 1 17 by the mayor with the consent of a majority of the city 1 18 council. Under current law, the mayor of a city with a mayor- 1 19 council form of government, and without civil service or an 1 20 intergovernmental agreement providing another method of 1 21 selection, appoints the marshal or chief of police without 1 22 consent of the council. 1 23 LSB 2025HC 79 1 24 tj/pj/5
