1 1 Section 1. Section 716.8, Code 2001, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 5. A person who commits a trespass on the
1 4 property of another that is under construction, commits a
1 5 class "C" felony if a sign is conspicuously posted on the
1 6 property that states substantially the following: THIS
1 7 PROPERTY IS UNDER CONSTRUCTION AND ANY PERSON WHO TRESPASSES
1 8 ON THIS PROPERTY COMMITS A CLASS "C" FELONY. For purposes of
1 9 this subsection, "construction" means a physical alteration of
1 10 a building or an improvement of real estate, and includes new
1 11 construction, enlargements, or additions to existing
1 12 construction, and alterations, renovation, remodeling,
1 13 restoration, preservation, or other material modification to
1 14 and within existing construction.
1 15 EXPLANATION
1 16 This bill creates a new criminal offense of trespassing on
1 17 property that is under construction, and provides a penalty.
1 18 The bill provides that any person who trespasses on
1 19 property that is under construction which also contains a
1 20 conspicuously placed sign stating the elements and punishment
1 21 of such an offense, commits a class "C" felony. The bill
1 22 defines "construction" to mean a physical alteration of a
1 23 building or an improvement of real estate, including new
1 24 construction, enlargements, additions and alterations,
1 25 renovations, remodeling, preservation, or other material
1 26 modification of existing construction.
1 27 A class "C" felony is punishable by confinement for no more
1 28 than 10 years and a fine of at least $1,000 but not more than
1 29 $10,000.
