PAG LIN 1 1 Section 1. Section 42.3, subsection 2, Code 2001, is 1 2 amended to read as follows: 1 3 2. If the bill embodying the plan submitted by the 1 4 legislative service bureau under subsection 1 fails to be 1 5 approved by a constitutional majority in either the senate or 1 6 the house of representatives,the secretary of the senate or1 7the chief clerk of the house, as the case may be, shall at1 8once transmit to the legislative service bureau information1 9which the senate or house may direct regarding reasons why the1 10plan was not approvedthe house rejecting the plan shall 1 11 convey the reasons for the rejection of the plan to the 1 12 legislative service bureau by resolution. The legislative 1 13 service bureau shall prepare a bill embodying a second plan of 1 14 legislative and congressional districting prepared in 1 15 accordance with section 42.4, and taking into account the 1 16 reasons cited by the senate or house of representatives for 1 17 its failure to approve the plan insofar as it is possible to 1 18 do so within the requirements of section 42.4. If a second 1 19 plan is required under this subsection, the bill embodying it 1 20 shall be delivered to the secretary of the senate and the 1 21 chief clerk of the house of representatives not later than May 1 22 1 of the year ending in one, or twenty-one days after the date 1 23 of the vote by which the senate or the house of 1 24 representatives fails to approve the bill submitted under 1 25 subsection 1, whichever date is later. It is the intent of 1 26 this chapter that, if it is necessary to submit a bill under 1 27 this subsection, the bill be brought to a vote not less than 1 28 seven days after the bill is printed and made available to the 1 29 members of the general assembly, in the same manner as 1 30 prescribed for the bill required under subsection 1. 1 31 Sec. 2. Section 42.3, subsection 3, Code 2001, is amended 1 32 to read as follows: 1 33 3. If the bill embodying the plan submitted by the 1 34 legislative service bureau under subsection 2 fails to be 1 35 approved by a constitutional majority in either the senate or 2 1 the house of representatives, the same procedure as prescribed 2 2 by subsection 2 shall be followed. If a third plan is 2 3 required under this subsection, the bill embodying it shall be 2 4 delivered to the secretary of the senate and the chief clerk 2 5 of the house of representatives not later than June 1 of the 2 6 year ending in one, or twenty-one days after the date of the 2 7 vote by which the senate or the house of representatives fails 2 8 to approve the bill submitted under subsection 2, whichever 2 9 date is later. It is the intent of this chapter that, if it 2 10 is necessary to submit a bill under this subsection, the bill 2 11 be brought to a vote within the same time period after its 2 12 delivery to the secretary of the senate and the chief clerk of 2 13 the house of representatives as is prescribed for the bill 2 14 submitted under subsection 2, but shall be subject to 2 15 amendmentin the same manner as other billsas provided by 2 16 this subsection. The senate or the house of representatives 2 17 shall be allowed to accept for filing as amendments only such 2 18 amendments which constitute the total text of a congressional 2 19 plan without striking a legislative redistricting plan, the 2 20 total text of a legislative redistricting plan without 2 21 striking a congressional plan, or the combined total text of a 2 22 congressional plan and a legislative redistricting plan, and 2 23 nonsubstantive, technical corrections to the text of any such 2 24 bills or amendments. 2 25 Sec. 3. EFFECTIVE DATE. This Act, being deemed of 2 26 immediate importance, takes effect upon enactment. 2 27 EXPLANATION 2 28 This bill concerns the consideration of proposed 2 29 congressional and legislative redistricting bills by the house 2 30 and senate. The bill provides that if a proposed 2 31 redistricting bill submitted by the legislative service bureau 2 32 is rejected, the house rejecting the plan shall convey the 2 33 reasons for the rejection to the bureau by resolution. In 2 34 addition, the bill provides that upon consideration of the 2 35 third proposed redistricting bill submitted by the legislative 3 1 service bureau, amendments to the plan are required to 3 2 constitute an entire new congressional redistricting plan, an 3 3 entire new legislative redistricting plan, or both, or be of a 3 4 nonsubstantive or technical nature. 3 5 The bill takes effect upon enactment. 3 6 LSB 1771HC 79 3 7 ec/gg/8
