  1  1    Section 1.  Section 19A.8, unnumbered paragraph 6, Code
  1  2 2001, is amended by striking the unnumbered paragraph.
  1  3    Sec. 2.  NEW SECTION.  19A.8B  DEPARTMENTAL OPERATIONS
  1  4 REVOLVING FUND.
  1  5    A departmental operations revolving fund is created in the
  1  6 state treasury under the control of the director of the
  1  7 department of personnel for the purpose of establishing a
  1  8 consolidated billing system.  The moneys credited to the fund
  1  9 are appropriated to the department for the purpose of paying
  1 10 the operational costs of the department of personnel.  All
  1 11 fees, grants, or specific appropriations for this purpose
  1 12 shall be credited to the fund.  The director shall render
  1 13 periodically a statement to each department, agency, and the
  1 14 judicial and legislative branches of government, as authorized
  1 15 by section 19A.1, subsection 5, for their pro rata share of
  1 16 the cost of operating the department of personnel.  The
  1 17 expense shall be paid by the state department, agency, or
  1 18 branch in the same manner as other expenses of that
  1 19 department, agency, or branch are paid and all moneys received
  1 20 shall be credited to the departmental operations revolving
  1 21 fund.  Notwithstanding section 8.33, any unencumbered or
  1 22 unobligated balance in the fund shall not revert.
  1 23    Sec. 3.  Section 19A.9, subsection 3, unnumbered paragraph
  1 24 3, Code 2001, is amended to read as follows:
  1 25    Vacancies and the closing date for applications for each
  1 26 vacancy shall be announced publicly at least fifteen days in
  1 27 advance of the date fixed for the filing of applications
  1 28 therefor, and shall be advertised through the communications
  1 29 media to the public, except for vacancies that are posted
  1 30 promotionally only for state employees at the discretion of
  1 31 the appointing authority.  The director may, however, in the
  1 32 director's discretion, continue to receive applications and
  1 33 examine candidates for a period adequate to assure a
  1 34 sufficient number of eligibles to meet the needs of the
  1 35 system, and may add the names of successful candidates to
  2  1 existing eligible lists.
  2  2    Sec. 4.  Section 19A.12, subsection 2, Code 2001, is
  2  3 amended to read as follows:
  2  4    2.  A training revolving fund is created in the state
  2  5 treasury.  The moneys credited to the fund shall be used for
  2  6 the purpose of paying actual and necessary expenses incurred
  2  7 by the department in administering the training system.  All
  2  8 fees, grants, or specific appropriations for this purpose
  2  9 shall be credited to the fund.  The fees for the training
  2 10 system courses shall be set by the director to cover the costs
  2 11 of course development, training materials, facilities and
  2 12 equipment, professional instructors, and administration,
  2 13 except for costs associated with the salary of employees of
  2 14 the department.  The fees shall be paid to the department by
  2 15 the state agency sending the employees for training and the
  2 16 payment shall be credited to the training revolving fund.
  2 17 Notwithstanding section 8.33, the department shall not revert
  2 18 any unencumbered or unobligated balance in the fund shall not
  2 19 revert.
  2 20    Sec. 5.  Section 19B.5, subsection 2, Code 2001, is amended
  2 21 to read as follows:
  2 22    2.  The department of personnel shall submit a report on
  2 23 the condition of affirmative action programs in state agencies
  2 24 covered by subsection 1 by September 30 of each year to the
  2 25 department of management governor.
  2 26    Sec. 6.  Section 19B.6, Code 2001, is amended to read as
  2 27 follows:
  2 28    19B.6  RESPONSIBILITIES OF DEPARTMENT OF PERSONNEL AND
  2 29 DEPARTMENT OF MANAGEMENT – AFFIRMATIVE ACTION.
  2 30    The department of management personnel shall oversee the
  2 31 implementation of sections 19B.1 through 19B.5 and shall work
  2 32 with the governor to ensure compliance with those sections,
  2 33 including the attainment of affirmative action goals and
  2 34 timetables, by all state agencies, including excluding the
  2 35 state board of regents and its institutions.  The department
  3  1 of management shall oversee the implementation of sections
  3  2 19B.1 through 19B.5 and shall work with the governor to ensure
  3  3 compliance with those sections, including the attainment of
  3  4 affirmative action goals and timetables, by the state board of
  3  5 regents and its institutions.  
  3  6                           EXPLANATION
  3  7    This bill provides a number of changes to the department of
  3  8 personnel's administrative authority and management
  3  9 responsibilities.
  3 10    Code section 19A.8 is amended to abolish the department of
  3 11 personnel's billing system with regard to departmental
  3 12 operational costs from health and dependent care flexible
  3 13 spending accounts.
  3 14    Code section 19A.8B is created to establish a centralized
  3 15 revolving fund for billing, depositing, and disbursing funds
  3 16 for all department of personnel transactions and services,
  3 17 with the fees collected appropriated to the department for the
  3 18 purpose of paying the operational costs of the department.
  3 19    Code section 19A.9 is amended to eliminate the 15-day
  3 20 timeline for public announcements of job vacancies.
  3 21    Code section 19A.12 is amended to eliminate the current
  3 22 restriction on the use of the Iowa management training system
  3 23 revolving fund to reimburse the department for employee
  3 24 salaries.
  3 25    Code section 19B.5 is amended to direct the department of
  3 26 personnel to file an affirmative action report with the
  3 27 governor's office, rather than with the department of
  3 28 management.
  3 29    Code section 19B.6 is amended to transfer the supervisory
  3 30 authority for the implementation of affirmative action
  3 31 programs in all state agencies from the department of
  3 32 management to the department of personnel, with the exception
  3 33 of the state board of regents.  The department of management
  3 34 will continue to supervise the state board of regents with
  3 35 respect to affirmative action programs.
