1 1 Section 1. Section 331.553, Code 2001, is amended by
1 2 adding the following new subsection:
1 3 NEW SUBSECTION. 7. Accept payment by credit card of
1 4 moneys collectible or receivable by the treasurer. If a
1 5 treasurer accepts credit card payments, the treasurer may add
1 6 a processing fee, which is equal to the cost to the treasurer
1 7 of a credit card transaction, to the credit card payment.
1 8 However, if, in lieu of a credit card, a payment is made by
1 9 check, guaranteed funds as defined in subsection 3, or a
1 10 method which the treasurer determines is substantially
1 11 equivalent to cash, the payment shall not include the amount
1 12 of the processing fee. If a treasurer accepts credit cards
1 13 for one or more payment purposes, the treasurer is not
1 14 required to accept all brands of credit cards or to accept
1 15 credit cards for all payment purposes.
1 16 Sec. 2. EFFECTIVE DATE. This Act, being deemed of
1 17 immediate importance, takes effect upon enactment.
1 18 EXPLANATION
1 19 This bill authorizes county treasurers to accept credit
1 20 card transactions for the payment of moneys collectible or
1 21 receivable by the treasurers. The treasurers may collect a
1 22 processing fee equal to the cost of a credit card transaction.
1 23 The processing fee must not be included if, in lieu of a
1 24 credit card transaction, a payment is made by check or cash
1 25 equivalent. County treasurers are not required to accept all
1 26 brands of credit cards or to accept a credit card transaction
1 27 for all payment purposes.
1 28 This bill takes effect upon enactment.
