PAG LIN 1 1 Section 1. The following amendment to the Constitution of 1 2 the State of Iowa is proposed: 1 3 1. Section 3 of Article III of the Constitution of the 1 4 State of Iowa is repealed and the following adopted in lieu 1 5 thereof: 1 6 REPRESENTATIVES. Sec. 3. The members of the House of 1 7 Representatives shall be chosen every second year, by the 1 8 qualified electors of their respective districts, and their 1 9 term of office shall commence on the first day of January next 1 10 after their election, and continue two years, and until their 1 11 successors are elected and qualified. A person shall not be 1 12 elected as a Representative more than six times. If a person 1 13 is elected to serve a portion of a term to which some other 1 14 person was elected, the partial term served shall not be 1 15 included as an election. 1 16 This limitation on the number of elections shall apply to 1 17 elections for terms of office beginning on or after January 1, 1 18 2005. 1 19 2. Section 5 of Article III of the Constitution of the 1 20 State of Iowa is repealed and the following adopted in lieu 1 21 thereof: 1 22 SENATORS QUALIFICATIONS. Sec. 5. Senators shall be 1 23 chosen for the term of four years, at the same time and place 1 24 as Representatives; they shall be twenty-five years of age, 1 25 and possess the qualifications of Representatives as to 1 26 residence and citizenship. A person shall not be elected as a 1 27 Senator more than three times. If a person is elected to 1 28 serve a portion of a term to which some other person was 1 29 elected, the partial term served shall not be included as an 1 30 election. 1 31 This limitation on the number of elections shall apply to 1 32 elections for terms of office beginning on or after January 1, 1 33 2005. 1 34 3. Section 2 of Article IV of the Constitution of the 1 35 State of Iowa, as amended by amendment number 1 of the 2 1 Amendments of 1972 and amendment number 1 of the Amendments of 2 2 1988, is repealed and the following adopted in lieu thereof: 2 3 ELECTION AND TERM. Sec. 2. The Governor and the 2 4 Lieutenant Governor shall be elected by the qualified electors 2 5 at the time and place of voting for members of the General 2 6 Assembly. Each of them shall hold office for four years from 2 7 the time of installation in office and until a successor is 2 8 elected and qualifies. A person shall not be elected Governor 2 9 or Lieutenant Governor more than three times. If a person 2 10 succeeds to the office of Governor to serve a portion of a 2 11 term to which some other person was elected Governor, the 2 12 partial term shall not be included as an election. If a 2 13 person is elected or appointed to serve as Lieutenant Governor 2 14 for a portion of a term to which some other person was elected 2 15 or appointed Lieutenant Governor, the partial term shall not 2 16 be included as an election. 2 17 This limitation on the number of elections shall apply to 2 18 elections for terms of office beginning on or after January 1, 2 19 2005. 2 20 4. Section 22 of Article IV of the Constitution of the 2 21 State of Iowa, as amended by amendment number 1 of the 2 22 Amendments of 1972, is repealed and the following adopted in 2 23 lieu thereof: 2 24 SECRETARY AUDITOR TREASURER. Sec. 22. A Secretary 2 25 of State, an Auditor of State and a Treasurer of State shall 2 26 be elected by the qualified electors at the same time that the 2 27 Governor is elected and for a four-year term commencing on the 2 28 first day of January next after their election, and they shall 2 29 perform such duties as may be provided by law. A person shall 2 30 not be elected Secretary of State more than three times. A 2 31 person shall not be elected Auditor of State more than three 2 32 times. A person shall not be elected Treasurer of State more 2 33 than three times. If a person is elected or appointed to 2 34 serve a portion of a term to which some other person was 2 35 elected or appointed, the partial term shall not be included 3 1 as an election. 3 2 This limitation on the number of elections shall apply to 3 3 elections for terms of office beginning on or after January 1, 3 4 2005. 3 5 5. Section 12 of Article V of the Constitution of the 3 6 State of Iowa, as amended by amendment number 1 of the 3 7 Amendments of 1972, is repealed and the following adopted in 3 8 lieu thereof: 3 9 ATTORNEY GENERAL. Sec. 12. The General Assembly shall 3 10 provide, by law, for the election of an Attorney General by 3 11 the people, whose term of office shall be four years, and 3 12 until a successor is elected and qualifies. A person shall 3 13 not be elected Attorney General more than three times. If a 3 14 person is elected or appointed to serve a portion of a term to 3 15 which some other person was elected or appointed, the partial 3 16 term shall not be included as an election. 3 17 This limitation on the number of elections shall apply to 3 18 elections for terms of office beginning on or after January 1, 3 19 2005. 3 20 Sec. 2. The foregoing amendment to the Constitution of the 3 21 State of Iowa is referred to the General Assembly to be chosen 3 22 at the next general election for members of the General 3 23 Assembly and the Secretary of State is directed to cause the 3 24 same to be published for three consecutive months previous to 3 25 the date of that election as provided by law. 3 26 EXPLANATION 3 27 This joint resolution proposes an amendment to the 3 28 Constitution of the State of Iowa to provide that members of 3 29 the Iowa house of representatives shall not be elected more 3 30 than six times and members of the Iowa senate shall not be 3 31 elected more than three times. A partial term to which some 3 32 other person was initially elected is not included as an 3 33 election. The limitation on the number of elections shall 3 34 only apply to elections for terms of office beginning on or 3 35 after January 1, 2005. 4 1 The resolution also provides that persons shall not be 4 2 elected to the office of governor, lieutenant governor, 4 3 attorney general, secretary of state, auditor of state, or 4 4 treasurer of state more than three times. A partial term to 4 5 which some other person was elected or appointed is not 4 6 included as an election. The limitation on the number of 4 7 elections shall only apply to elections for terms of office 4 8 beginning on or after January 1, 2005. 4 9 The resolution, if adopted, would be referred to the next 4 10 general assembly before being submitted to the electorate for 4 11 ratification. 4 12 LSB 1386HH 79 4 13 sc/cls/14
