1 1 Section 1. Section 8.57, Code 2001, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 6. a. A volunteer fire fighters pension
1 4 fund is created in the state treasury under the authority of
1 5 the department of management. The fund shall consist of
1 6 appropriations made to the fund and transfers of interest,
1 7 earnings, and moneys from other funds as provided by law. The
1 8 fund shall be separate from the general fund of the state and
1 9 the balance in the fund shall not be considered part of the
1 10 balance of the general fund of the state. However, the fund
1 11 shall be considered a special account for the purposes of
1 12 section 8.53, relating to generally accepted accounting
1 13 principles.
1 14 b. Moneys in the volunteer fire fighters pension fund are
1 15 not subject to section 8.33. Notwithstanding section 12C.7,
1 16 subsection 2, interest or earnings on moneys in the fund shall
1 17 be credited to the fund.
1 18 c. Moneys in the volunteer fire fighters pension fund in a
1 19 fiscal year shall be used to provide pensions for qualified
1 20 volunteer fire fighters. A formula for distributions from the
1 21 fund shall be established by law.
1 22 d. For the fiscal year beginning July 1, 2004, five
1 23 hundred thousand dollars of premium tax receipts collected in
1 24 that fiscal year pursuant to section 432.1, subsection 2, from
1 25 property and casualty insurance, shall be deposited in the
1 26 volunteer fire fighters pension fund. For each fiscal year
1 27 thereafter, an amount of such premium tax receipts equal to
1 28 the amount deposited in the previous fiscal year plus five
1 29 hundred thousand dollars shall be deposited in the volunteer
1 30 fire fighters pension fund until the amount annually deposited
1 31 in such fund reaches five million dollars. Thereafter, the
1 32 amount of premium tax receipts that shall be deposited in the
1 33 volunteer fire fighters pension fund in each fiscal year shall
1 34 be five million dollars. The moneys deposited in the
1 35 volunteer fire fighters pension fund shall be used as provided
2 1 in this subsection.
2 2 Sec. 2. Section 8.58, Code 2001, is amended to read as
2 3 follows:
2 4 8.58 EXEMPTION FROM AUTOMATIC APPLICATION.
2 5 To the extent that moneys appropriated under section 8.57
2 6 do not result in moneys being credited to the general fund
2 7 under section 8.55, subsection 2, moneys appropriated under
2 8 section 8.57 and moneys contained in the cash reserve fund,
2 9 rebuild Iowa infrastructure fund, environment first fund,
2 10 volunteer fire fighters pension fund, and Iowa economic
2 11 emergency fund shall not be considered in the application of
2 12 any formula, index, or other statutory triggering mechanism
2 13 which would affect appropriations, payments, or taxation
2 14 rates, contrary provisions of the Code notwithstanding.
2 15 To the extent that moneys appropriated under section 8.57
2 16 do not result in moneys being credited to the general fund
2 17 under section 8.55, subsection 2, moneys appropriated under
2 18 section 8.57 and moneys contained in the cash reserve fund,
2 19 rebuild Iowa infrastructure fund, environment first fund,
2 20 volunteer fire fighters pension fund, and Iowa economic
2 21 emergency fund shall not be considered by an arbitrator or in
2 22 negotiations under chapter 20.
2 23 Sec. 3. VOLUNTEER FIRE FIGHTERS PENSION TASK FORCE
2 24 REPORT. A volunteer fire fighters pension task force is
2 25 created concerning the establishment of a pension system for
2 26 volunteer fire fighters in this state. The task force shall
2 27 examine pension plans established by other states for
2 28 volunteer fire fighters and shall solicit information from
2 29 volunteer fire fighters, and cities and townships with
2 30 volunteer fire fighters, concerning the establishment of a
2 31 pension system for volunteer fire fighters. The task force
2 32 shall also determine a procedure by which a city, township,
2 33 county, or benefited fire district fire department may elect
2 34 to join the pension system.
2 35 Membership of the task force is to be determined by the
3 1 legislative council. Members shall be appointed by the
3 2 legislative council. The membership shall include, but not be
3 3 limited to, the following:
3 4 1. The commissioner of insurance or the commissioner's
3 5 designee.
3 6 2. The treasurer of state or the treasurer's designee.
3 7 3. A representative of a pension system established
3 8 pursuant to Code chapter 411.
3 9 4. A representative of the Iowa public employees'
3 10 retirement system.
3 11 5. A representative of a pension system established for
3 12 private sector employees.
3 13 6. A representative of the state fire and emergency
3 14 response council.
3 15 7. A representative of volunteer fire fighters in the
3 16 state.
3 17 8. A representative of township trustees.
3 18 9. A representative of cities.
3 19 The legislative service bureau and the legislative fiscal
3 20 bureau shall provide staffing assistance to the task force.
3 21 The department of management shall provide other assistance to
3 22 the task force in completing its duties.
3 23 The task force shall submit a report to the general
3 24 assembly by January 1, 2003. The report shall contain the
3 25 findings and recommendations of the task force.
