1 1 Section 1. NEW SECTION. 124.511 DISSEMINATION OF
1 2 INFORMATION BY LAW ENFORCEMENT AGENCY.
1 3 A law enforcement agency shall provide information to a
1 4 public or nonpublic elementary or secondary school regarding a
1 5 person who unlawfully possesses, delivers, or possesses with
1 6 intent to deliver, a controlled substance, in, on, or within
1 7 one thousand feet of a school within the agency's
1 8 jurisdiction. The information provided shall include, but is
1 9 not limited to, the person's name and a physical description
1 10 of the person. A law enforcement agency shall provide to any
1 11 person upon request the same information provided to a school
1 12 under this section. Information shall only be provided to a
1 13 school or person pursuant to this section if the law
1 14 enforcement agency is not prohibited from doing so by any
1 15 other provision of law.
1 16 EXPLANATION
1 17 This bill requires a law enforcement agency to provide
1 18 information regarding a person who unlawfully possesses,
1 19 delivers, or possesses with intent to deliver, a controlled
1 20 substance within 1,000 feet of a public or nonpublic
1 21 elementary or secondary school. The bill provides that the
1 22 information provided shall include, but is not limited to, the
1 23 person's name and a physical description of the person. The
1 24 bill also provides that upon request a law enforcement agency
1 25 shall provide the same information to a member of the general
1 26 public.
1 27 The bill provides that information shall only be provided
1 28 to a school or a member of the general public if the law
1 29 enforcement agency is not prohibited from doing so by any
1 30 other provision of law.
