1 1 Section 1. ALLOWED GROWTH FACTOR ADJUSTMENT DISTRIBUTION
1 2 FY 2002-2003. For the fiscal year beginning July 1, 2002, and
1 3 ending June 30, 2003, in order for a county to be eligible for
1 4 the county's portion of the allowed growth factor adjustment
1 5 appropriation distributed for that fiscal year in accordance
1 6 with section 331.438, the county must levy for the fiscal year
1 7 at least seventy percent of the maximum levy amount allowed
1 8 for the county's mental health, mental retardation, and
1 9 developmental disabilities services fund under section
1 10 331.424A. For that fiscal year, an ineligible county's
1 11 portion shall be divided among the eligible counties based
1 12 upon an eligible county's proportion of total general
1 13 population of the eligible counties.
1 14 Sec. 2. EFFECTIVE DATE. This Act, being deemed of
1 15 immediate importance, takes effect upon enactment.
1 16 EXPLANATION
1 17 This bill relates to county eligibility for state payment
1 18 of the allowed growth factor adjustment for county mental
1 19 health, mental retardation, and developmental disabilities
1 20 (MH/MR/DD) services for fiscal year 2002-2003.
1 21 Current law limits the maximum levy for a county's MH/MR/DD
1 22 services fund to a base year expenditure amount less the state
1 23 property tax relief payment amount to be received by the
1 24 county. The law provides for state payment of an allowed
1 25 growth adjustment amount to address increased costs. The bill
1 26 conditions a county's eligibility for the county's portion of
1 27 the state's allowed growth adjustment appropriation on the
1 28 county levying for fiscal year 2002-2003 at least 70 percent
1 29 of the maximum amount allowed for the MH/MR/DD services fund.
1 30 If a county does not meet the eligibility requirement, an
1 31 ineligible county's portion of the appropriation is to be
1 32 divided among the eligible counties.
1 33 The bill takes effect upon enactment.
