  1  1    Section 1.  Section 147A.10, Code 2001, is amended by
  1  2 adding the following new subsection:
  1  3    NEW SUBSECTION.  4.  A physician, physician's designee,
  1  4 advanced registered nurse practitioner, or physician assistant
  1  5 who voluntarily and gratuitously, and other than in the
  1  6 ordinary course of employment or practice, responds to a need
  1  7 for medical care created by an emergency or a state or local
  1  8 disaster, is not subject to criminal liability by reason of
  1  9 having issued or executed the orders for such care that the
  1 10 physician, physician's designee, advanced registered nurse
  1 11 practitioner, or physician assistant is authorized to provide,
  1 12 and is not liable for civil damages for acts or omissions
  1 13 relating to the issuance or execution of the orders unless the
  1 14 acts or omissions constitute recklessness.
  1 15    Sec. 2.  Section 148C.4, Code Supplement 2001, is amended
  1 16 to read as follows:
  1 17    148C.4  SERVICES PERFORMED BY ASSISTANTS.
  1 18    1.  A physician assistant may perform medical services when
  1 19 the services are rendered under the supervision of the
  1 20 physician or physicians specified in the physician assistant
  1 21 license approved by the board.  A trainee may perform medical
  1 22 services when the services are rendered within the scope of an
  1 23 approved program.  For the purposes of this section, "medical
  1 24 services rendered under the supervision of the physician or
  1 25 physicians specified in the physician assistant license
  1 26 approved by the board" includes making a pronouncement of
  1 27 death for a patient whose death is anticipated if the death
  1 28 occurs in a licensed hospital, a licensed health care
  1 29 facility, a Medicare-certified home health agency, or a
  1 30 Medicare-certified hospice program or facility, with notice of
  1 31 the death to a physician and in accordance with the directions
  1 32 of a physician.
  1 33    2.  Notwithstanding subsection 1, a physician assistant
  1 34 licensed pursuant to this chapter or authorized to practice in
  1 35 any other state who voluntarily and gratuitously, and other
  2  1 than in the ordinary course of the physician assistant's
  2  2 employment or practice, responds to a need for medical care
  2  3 created by an emergency or a state or local disaster may
  2  4 render such care that the physician assistant is able to
  2  5 provide without the supervision of the physician or physicians
  2  6 specified in the physician assistant license, or under such
  2  7 supervision as is available.  A physician who supervises a
  2  8 physician assistant providing medical care pursuant to this
  2  9 paragraph shall not be required to meet the requirements of
  2 10 section 148C.3, subsection 4, relating to supervising
  2 11 physician qualifications.
