PAG LIN 1 1 HOUSE FILE 2518 1 2 1 3 AN ACT 1 4 RELATING TO CHILD FOSTER CARE AND ADOPTION REQUIREMENTS 1 5 INVOLVING LICENSING PERIODS, FOSTER PARENT TRAINING, AND 1 6 ANNUAL REPORTS. 1 7 1 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 9 1 10 Section 1. Section 237.3, subsection 2, paragraph f, 1 11 unnumbered paragraph 1, Code Supplement 2001, is amended to 1 12 read as follows: 1 13 Housing, health, safety, and medical care policies for 1 14 children receiving child foster care. The medical care 1 15 policies shall include but are not limited tobothall of the 1 16 following: 1 17 Sec. 2. Section 237.3, subsection 2, paragraph f, Code 1 18 Supplement 2001, is amended by adding the following new 1 19 subparagraph as subparagraph (1) and renumbering the existing 1 20 subparagraphs: 1 21 NEW SUBPARAGRAPH. (1) Provision by the department to the 1 22 foster care provider at or before the time of a child's 1 23 placement of the child's health records and any other 1 24 information possessed or known about the health of the child 1 25 or about a member of the child's family that pertains to the 1 26 child's health. 1 27 Sec. 3. Section 237.5, subsection 1, Code 2001, is amended 1 28 to read as follows: 1 29 1. An individual or an agency shall apply for a license by 1 30 completing an application to the administrator upon forms 1 31 furnished by the administrator. The administrator shall issue 1 32 or reissue a license if the administrator determines that the 1 33 applicant or licensee is or upon commencing operation will 1 34 provide child foster care in compliance with this chapter. A 1 35 license for an individual is valid for one year from the date 2 1 of issuance. A license for an agency is valid for up to three 2 2 years from the date of issuance for the period determined by 2 3 the administrator in accordance with administrative rules 2 4 providing criteria for making the determination. The license 2 5 shall state on its face the name of the licensee, the type of 2 6 facility, the particular premises for which the license is 2 7 issued, and the number of children who may be cared for by the 2 8 facility on the premises at one time. The license shall be 2 9 posted in a conspicuous place in the physical plant of the 2 10 facility, except that if the facility is in a single-family 2 11 home the license may be kept where it is readily available for 2 12 examination upon request. 2 13 Sec. 4. Section 237.5A, Code 2001, is amended to read as 2 14 follows: 2 15 237.5A FOSTER PARENT TRAINING. 2 16 As a condition for initial licensure, each individual 2 17 licensee shall completetwelvethirty hours of foster parent 2 18 training offered or approved by the department. Prior to 2 19 annual renewal of licensure, each individual licensee shall 2 20 also complete six hours of foster parent training. The 2 21 training shall include but is not limited to physical care, 2 22 education, learning disabilities, referral to and receipt of 2 23 necessary professional services, behavioral assessment and 2 24 modification, self-assessment, self-living skills, and 2 25 biological parent contact. An individual licensee may 2 26 complete the training as part of an approved training program 2 27 offered by a public or private agency with expertise in the 2 28 provision of child foster care or in related subject areas. 2 29 The department shall adopt rules to implement and enforce this 2 30 training requirement. 2 31 Sec. 5. Section 238.3, Code 2001, is amended to read as 2 32 follows: 2 33 238.3POWERAUTHORITY TO LICENSE. 2 34 The administratoris hereby empowered tomay grant a 2 35 license under this chapter forone yearthe period specified 3 1 in section 238.9 for the conduct of any child-placing agency 3 2that is for the public good, and is conducted by a reputable3 3and responsible personin this state. 3 4 Sec. 6. Section 238.9, Code 2001, is amended to read as 3 5 follows: 3 6 238.9TENURETERM OF LICENSE. 3 7LicensesA license granted under this chapter shall be 3 8 valid forone yearthree years from the date of issuance 3 9thereofunless the license is revoked in accordance withthe3 10provisions hereofsection 238.10. 3 11 Sec. 7. Section 238.24, Code 2001, is amended to read as 3 12 follows: 3 13 238.24 INFORMATION CONFIDENTIAL. 3 14 1.No individualExcept as authorized by this section, a 3 15 person who acquiresthrough the operation of the provisions of3 16sections 238.17 to 238.23, inclusive,under this chapter or 3 17 from the records provided for in this chapter, information 3 18 relative to any agency or relative to anypersonindividual 3 19 cared for bysuchthe agency or relative to any relative of 3 20any such personthe individual, shall not directly or 3 21 indirectly disclosesuchthe informationexcept. 3 22 2. Disclosure of information acquired under this chapter 3 23 or from the records provided for in this chapter is authorized 3 24 under any of the following circumstances: 3 25 a.uponDisclosure made upon inquiry before a court of 3 26 law, or before some other tribunal, or for the information of 3 27 the governor, general assembly, medical examiners, 3 28 administrator, Iowa department of public health, or the local 3 29 board of health in the jurisdiction wheresuchthe agency is 3 30 located. 3 31 b.Nothing herein shall prohibit theDisclosure may be 3 32 made by the administratorfrom disclosing such facts to such3 33 to proper persons as may be in the interest of a child cared 3 34 for bysuchthe agency or in the interest of the child's 3 35 parents or foster parents and not inimical to the child, or as 4 1 may be necessary to protect the interests of the child's 4 2 prospective foster parents. However, disclosure of 4 3 termination and adoption records shall be governed by the 4 4 provisions of sections 600.16 and 600.16A. 4 5 c.Nothing herein shall prohibit theDisclosure for 4 6 purposes of statistical analysis performed by duly authorized 4 7 persons of data collectedby virtue ofunder this chapter or 4 8 the publication of the results of such analysis in such manner 4 9 as will not disclose confidential information. 4 10 Sec. 8.
