1 4 CREATING A CRIMINAL OFFENSE FOR POSSESSION OR DISTRIBUTION OF
1 5 ANTHRAX, AND PROVIDING A PENALTY.

1 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 9 Section 1. NEW SECTION. 126.24 ANTHRAX.
1 10 1. UNLAWFUL POSSESSION. Any person who knowingly
1 11 possesses bacillus anthracis or any substance containing
1 12 bacillus anthracis, is guilty of a class "C" felony.
1 13 2. UNLAWFUL DISTRIBUTION. Any person who knowingly
1 14 distributes bacillus anthracis or any substance containing
1 15 bacillus anthracis to any other person which may or may not
1 16 cause exposure to bacillus anthracis, is guilty of a class "B"
1 17 felony.
1 18 3. EXCEPTIONS. This section shall not apply to a person
1 19 who possesses or distributes bacillus anthracis or any
1 20 substance containing bacillus anthracis which is being used
1 21 solely for a purpose which is lawfully authorized under
1 22 federal law.
