PAG LIN 1 1 Section 1. Section 321.445, subsection 2, paragraph e, 1 2 Code Supplement 2001, is amended to read as follows: 1 3 e. A person possessing a written certification from a 1 4 health care provider licensed under chapter 148, 150, 150A, or 1 5 151 on a form provided by the department that the person is 1 6 unable to wear a safety belt or safety harness due to physical 1 7 or medical reasons. The certification shall specify the time 1 8 period for which the exemption applies.The time period shall1 9not exceed twelve months, at which time a new certification1 10may be issued unless the certifying health care provider is1 11from a United States military facility, in which case the1 12certificate may specify a longer period of time or a permanent1 13exemption.The department shall make available to a person 1 14 possessing a written certification under this paragraph a 1 15 window decal or placard that may be placed in the window of a 1 16 vehicle being operated by the person to indicate the person's 1 17 exemption from the requirements of this subsection pursuant to 1 18 rules adopted by the department. 1 19 EXPLANATION 1 20 This bill provides for the creation of a removable seat 1 21 belt exemption window decal or placard for display in the 1 22 window of a motor vehicle by persons who are exempt from the 1 23 requirements of Code section 321.445 for seat belt or safety 1 24 harness use due to physical or medical reasons certified by a 1 25 health care provider. 1 26 The bill also allows a person to be permanently exempted 1 27 from the seat belt or safety harness requirement pursuant to 1 28 any health care provider's certification. Currently, a person 1 29 is required to obtain a new certification every 12 months 1 30 unless the certifying health care provider is from a United 1 31 States military facility. 1 32 LSB 5626HV 79 1 33 av/sh/8
