  1  1    Section 1.  Section 403.5, Code 2001, is amended by adding
  1  2 the following new subsection:
  1  3    NEW SUBSECTION.  4A.  An urban renewal plan shall not take
  1  4 effect until the governing body of each affected taxing entity
  1  5 has, by resolution, approved the plan and forwarded the
  1  6 resolution to the city clerk or county auditor, as applicable.
  1  7 A modification or amendment to an urban renewal plan shall not
  1  8 take effect until the governing body of each affected taxing
  1  9 entity has, by resolution, approved the modification or
  1 10 amendment and forwarded the resolution to the city clerk or
  1 11 county auditor, as applicable.
  1 12    Sec. 2.  Section 403.5, subsection 6, Code 2001, is amended
  1 13 to read as follows:
  1 14    6.  Upon the approval by a municipality and affected taxing
  1 15 entities of an urban renewal plan or of any modification
  1 16 thereof, such plan or modification shall be deemed to be in
  1 17 full force and effect for the respective urban renewal area,
  1 18 and the municipality may then cause such plan or modification
  1 19 to be carried out in accordance with its terms.
  1 20    Sec. 3.  EFFECTIVE AND APPLICABILITY DATES.  This Act,
  1 21 being deemed of immediate importance, takes effect upon
  1 22 enactment and applies to urban renewal plans approved by a
  1 23 municipality on or after the effective date of this Act.  
  1 24                           EXPLANATION
  1 25    This bill provides that before an urban renewal plan, or a
  1 26 modification or an amendment to an urban renewal plan, can
  1 27 take effect it has to be approved by resolution of the
  1 28 governing body of each affected taxing entity.
  1 29    Affected taxing entity is defined as a city, community
  1 30 college, county, or school district that certified a property
  1 31 tax to be levied on property in the proposed urban renewal
  1 32 area in the fiscal year prior to the calendar year in which
  1 33 the plan, or amendment to the plan, is submitted for approval.
  1 34    The bill takes effect upon enactment and applies to urban
  1 35 renewal plans approved by a municipality on or after the
  2  1 effective date of the bill.
