  1  1    Section 1.  Section 321.463, subsection 4, paragraph a,
  1  2 Code Supplement 2001, is amended to read as follows:
  1  3    4.  a.  (1)  Self-propelled implements Notwithstanding any
  1  4 provision of this section to the contrary, the weight on any
  1  5 one axle of a self-propelled implement of husbandry used
  1  6 exclusively for the application of organic or inorganic plant
  1  7 food materials, agricultural limestone, or agricultural
  1  8 chemicals shall be operated in compliance with this section on
  1  9 the highways of this state shall not exceed twenty-four
  1 10 thousand pounds from February 1 through May 31, or twenty-
  1 11 eight thousand pounds from June 1 through January 31,
  1 12 provided, however, that the maximum gross vehicle weight of
  1 13 the self-propelled implement of husbandry shall not exceed
  1 14 ninety-six thousand pounds.
  1 15    A self-propelled implement of husbandry shall comply with
  1 16 the other provisions of this section and chapter when operated
  1 17 over a bridge in this state.  A local authority may issue a
  1 18 special permit, based on a statewide standard developed by the
  1 19 department, allowing the operation over a bridge within its
  1 20 jurisdiction of a self-propelled implement of husbandry with a
  1 21 weight in excess of the weights allowed under this chapter.
  1 22    (2)  For purposes of this paragraph "a", "highway" does not
  1 23 include a bridge.
  1 24    For purposes of this paragraph "a", "self-propelled
  1 25 implement of husbandry" means all of the following:
  1 26    (a)  A self-propelled implement of husbandry used
  1 27 exclusively for the application of organic or inorganic plant
  1 28 food materials, agricultural limestone, or agricultural
  1 29 chemicals manufactured on or after July 1, 2003.
  1 30    (b)  After July 1, 2006, any self-propelled implement of
  1 31 husbandry used exclusively for the application of organic or
  1 32 inorganic plant food materials, agricultural limestone, or
  1 33 agricultural chemicals.
  1 34    The year of manufacture of a self-propelled implement of
  1 35 husbandry manufactured on or after July 1, 2003, shall be
  2  1 permanently made a part of the identification plate on the
  2  2 vehicle.  Fraudulently altering or defacing or attempting to
  2  3 fraudulently alter or deface the year of manufacture or other
  2  4 product identification number on a self-propelled implement of
  2  5 husbandry is a violation of section 321.92.  
  2  6                           EXPLANATION
  2  7    This bill amends Code section 321.463 to allow an exception
  2  8 to maximum gross weight limits per axle during six months of
  2  9 the year for certain agricultural equipment which is used
  2 10 exclusively for the application of organic or inorganic plant
  2 11 food materials, agricultural limestone, or agricultural
  2 12 chemicals.  This exception to the gross weight limits is
  2 13 already available for fence-line feeders, grain carts, and
  2 14 tank wagons.
  2 15    The bill provides that identification plates of self-
  2 16 propelled implements of husbandry manufactured on or after
  2 17 July 1, 2003, must include the year of manufacture.
  2 18 Fraudulent alteration or defacement of the year of manufacture
  2 19 or the product identification number on an identification
  2 20 plate is a class "D" felony punishable by confinement for no
  2 21 more than five years and a fine of at least $750 but not more
  2 22 than $7,500.
