1 1 Section 1. Section 331.210A, subsection 2, Code 2001, is
1 2 amended by adding the following new paragraph:
1 3 NEW PARAGRAPH. f. Notwithstanding the provisions of this
1 4 section to the contrary, for a county with a population of
1 5 ninety-five thousand or more that is required to draw a plan
1 6 "three" supervisor representation plan, the legislative
1 7 service bureau, and not the temporary county redistricting
1 8 commission, shall draw a first plan as required by paragraph
1 9 "a". The plan drawn by the legislative service bureau shall
1 10 be based upon the precinct plan adopted for use by the county
1 11 and shall be drawn in accordance with section 42.4. The plan
1 12 drawn by the legislative service bureau shall be submitted to
1 13 the temporary county redistricting commission which shall
1 14 perform the duties required by paragraphs "b" and "c"
1 15 concerning the plan. After the requirements of paragraphs "b"
1 16 and "c" have been met, the plan drawn by the legislative
1 17 service bureau shall be submitted to the board or supervisors
1 18 for its approval or rejection. If the plan drawn by the
1 19 legislative service bureau is rejected by the board of
1 20 supervisors, the board of supervisors shall direct the
1 21 temporary county redistricting commission to prepare a second
1 22 plan as provided by paragraph "d".
1 23 EXPLANATION
1 24 This bill provides that the legislative service bureau
1 25 shall draw a first supervisor redistricting plan for plan
1 26 "three" counties with a population of 95,000 or more in lieu
1 27 of the plan being drawn by the temporary county redistricting
1 28 commission. The plan drawn by the legislative service bureau
1 29 shall be submitted to the temporary county redistricting
1 30 commission which will still be required to conduct a public
1 31 hearing concerning the first plan and prepare a report
1 32 concerning the plan. Following the public hearing and
1 33 submission of the commission's report, the plan drawn by the
1 34 legislative service bureau shall be submitted to the county
1 35 board of supervisors for its approval or rejection. If the
2 1 first plan is rejected, the temporary county redistricting
2 2 commission, and not the legislative service bureau, would draw
2 3 a second plan. Plan "three" counties are those counties which
2 4 elect supervisors from a district within the county.
