1 4 RELATING TO THE APPLICABILITY OF THE THERMAL EFFICIENCY
1 5 ENERGY CONSERVATION STANDARDS IN THE STATE BUILDING CODE.

1 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 9 Section 1. Section 103A.8A, Code 2001, is amended to read
1 10 as follows:
1 11 103A.8A MINIMUM ENERGY EFFICIENCY STANDARD.
1 12 The state building code commissioner shall adopt as a part
1 13 of the state building code a requirement that new single-
1 14 family or two-family residential construction shall meet an
1 15 established minimum energy efficiency standard. The standard
1 16 shall be stated in terms of the home heating index developed
1 17 by the physics department at Iowa state university of science
1 18 and technology. The minimum standard shall be the average
1 19 energy consumption of new single-family or two-family
1 20 residential construction as determined by a survey conducted
1 21 by the energy and geological resources division of the
1 22 department of natural resources of the average actual energy
1 23 consumption, as expressed in terms of the home heating index.
1 24 The minimum standard shall only apply to single-family or two-
1 25 family residential construction commenced after the adoption
1 26 of the standard. This chapter shall not be construed to
1 27 prohibit a governmental subdivision from adopting or enacting
1 28 a minimum energy standard which is substantially in accordance
1 29 and consistent with model energy codes and standards developed
1 30 by a nationally recognized organization in effect on or after
1 31 the effective date of this Act. A governmental subdivision
1 32 that adopts or enacts a minimum energy standard which is
1 33 substantially in accordance and consistent with model energy
1 34 codes and standards developed by a nationally recognized
1 35 organization shall adopt or enact any update or revision to
2 1 the model energy codes and standards.
2 2 Sec. 2. Section 103A.10, Code 2001, is amended by adding
2 3 the following new subsection:
2 4 NEW SUBSECTION. 5. This chapter shall not be construed to
2 5 prohibit a governmental subdivision from adopting or enacting
2 6 a minimum energy standard which is substantially in accordance
2 7 and consistent with model energy codes and standards developed
2 8 by a nationally recognized organization in effect on or after
2 9 the effective date of this Act. A governmental subdivision
2 10 that adopts or enacts a minimum energy standard which is
2 11 substantially in accordance and consistent with model energy
2 12 codes and standards developed by a nationally recognized
2 13 organization shall adopt or enact any update or revision to
2 14 the model energy codes and standards.
