PAG LIN 1 1 Section 1. NEW SECTION. 280.28 CLASSROOM CONDUCT CODE. 1 2 1. A code of classroom conduct shall be developed by each 1 3 school district, and reviewed on an annual basis, commencing 1 4 with the school budget year beginning July 1, 2002. The code 1 5 shall be adopted by the school district board of directors 1 6 after consultation with a classroom conduct committee 1 7 comprised of residents of the school district. The committee 1 8 shall consist of parents, pupils, members of the school board, 1 9 school administrators, teachers, counselors employed by the 1 10 school district, and other residents of the school district 1 11 appointed to the committee by the board. The code of 1 12 classroom conduct shall not be required to be uniform across 1 13 school districts, but shall, at a minimum, include the 1 14 following: 1 15 a. A determination of what constitutes dangerous, 1 16 disruptive, or unruly behavior, or behavior which interferes 1 17 with the ability of a teacher to teach effectively, and which 1 18 warrants removal of a pupil from the classroom. 1 19 b. A procedure for the notification of a parent or 1 20 guardian of a pupil that the pupil has been removed from a 1 21 classroom. 1 22 c. A procedure for determining the appropriate alternative 1 23 placement of a pupil who has been removed from a classroom. 1 24 d. Provisions which are consistent with sections 280.21, 1 25 280.21B, 280.24, 282.4, and 282.5. 1 26 2. A teacher may remove a pupil from a classroom for a 1 27 violation of the school district's code of classroom conduct. 1 28 A pupil who has been removed from a classroom shall 1 29 immediately be sent to the office of the school principal, and 1 30 the pupil's parent or guardian shall be notified of the 1 31 removal. 1 32 Sec. 2. Section 284.4, subsection 1, Code Supplement 2001, 1 33 is amended by adding the following new paragraph: 1 34 NEW PARAGRAPH. h. Adopt a classroom code of conduct 1 35 pursuant to section 280.28. 2 1 EXPLANATION 2 2 This bill provides for the establishment of a classroom 2 3 conduct code by school districts. The bill provides that a 2 4 code of classroom conduct shall be developed by each school 2 5 district, and reviewed on an annual basis, commencing with the 2 6 school budget year beginning July 1, 2002. The bill provides 2 7 that the code shall be adopted by the school district board of 2 8 directors after consultation with a classroom conduct 2 9 committee appointed by the board and comprised of residents of 2 10 the school district. The bill provides that the code of 2 11 classroom conduct does not need to be uniform across school 2 12 districts, but that it shall, at a minimum, include a 2 13 determination of what constitutes dangerous, disruptive, or 2 14 unruly behavior, or behavior which interferes with the ability 2 15 of a teacher to teach effectively, and which warrants removal 2 16 of a pupil from the classroom, and notification and 2 17 alternative placement procedures. The bill also provides that 2 18 the code of classroom conduct shall be consistent with other 2 19 code provisions dealing with corporal punishment, weapons in 2 20 school, drug or alcohol possession, and suspension and 2 21 expulsion of pupils. 2 22 The bill provides that a teacher may remove a pupil from a 2 23 classroom for a violation of the school district's code of 2 24 classroom conduct, and that a pupil who has been removed from 2 25 a classroom shall immediately be sent to the office of the 2 26 school principal. The pupil's parent or guardian shall be 2 27 notified of the removal. 2 28 The bill adds establishing a code of classroom conduct to 2 29 the list of requirements that school districts must be willing 2 30 to undertake in order to receive funds pursuant to the student 2 31 achievement and teacher quality program under Code chapter 2 32 284. 2 33 LSB 6266HH 79 2 34 rn/pj/5
