PAG LIN 1 1 Section 1. Section 80B.11B, Code 2001, is amended by 1 2 adding the following new subsection: 1 3 NEW SUBSECTION. 4. The Iowa law enforcement academy may 1 4 charge a certified law enforcement training facility 1 5 established pursuant to section 80B.12, a per student fee 1 6 sufficient to offset the administrative costs incurred by the 1 7 academy for inspecting and certifying the facilities. 1 8 Sec. 2. Section 80B.12, Code 2001, is amended to read as 1 9 follows: 1 10 80B.12 AGREEMENTS WITHOTHERAGENCIES, COLLEGES, OR 1 11 UNIVERSITIES. 1 12 1. The director, with the approval of the council,may1 13enter into agreements with othershall permit public and 1 14 private agencies, public and nonpublic colleges,and1 15 universitiesto carry out the intent of this chapter, and 1 16 community colleges to apply for certification as a law 1 17 enforcement training facility. 1 18 2. The director, with the approval of the council, shall 1 19 set the standards to obtain certification by rule adopted 1 20 pursuant to chapter 17A. The rules shall specifically state 1 21 the standards required to obtain certification. The standards 1 22 shall not be any more stringent than standards set for law 1 23 enforcement training conducted by a governmental agency under 1 24 section 80B.11. 1 25 3. Any training facility qualifying for certification 1 26 based upon the standards adopted by rule shall be certified by 1 27 the director. Criteria other than the standards adopted by 1 28 rule shall not be used as a basis for denying certification. 1 29 Sec. 3. Section 80B.13, unnumbered paragraph 1, Code 2001, 1 30 is amended to read as follows: 1 31TheExcept for subsections 2 and 3 where the council shall 1 32 issue certificates, the council may do all of the following: 1 33 Sec. 4. Section 80B.13, subsections 1 and 2, Code 2001, 1 34 are amended to read as follows: 1 35 1. Designate members to visit and inspect any law 2 1 enforcement or jailer training schools or facilities, or 2 2 examine the curriculum or training procedures, for which 2 3 application for approval has been made. 2 4 2. Issue certificates to law enforcement training schools 2 5 or facilities qualifying under theregulationsrules of the 2 6 council. 2 7 EXPLANATION 2 8 This bill relates to certifying law enforcement training 2 9 facilities at postsecondary educational institutions. 2 10 The bill provides that the director of the Iowa law 2 11 enforcement academy, with approval of the Iowa law enforcement 2 12 academy council, shall permit public and private universities 2 13 and colleges, including community colleges, to apply for 2 14 certification as a law enforcement training facility. The 2 15 bill provides that the director, with approval of the council, 2 16 shall set the standards to obtain certification by 2 17 administrative rule. The bill provides that the rules shall 2 18 specifically state the standards required to obtain 2 19 certification. Any training facility qualifying for 2 20 certification based upon the standards adopted by rule shall 2 21 be certified. Criteria other than the standards adopted by 2 22 rule shall not be used as a basis for denying certification. 2 23 The bill provides that the Iowa law enforcement academy may 2 24 charge a facility certified under this bill a per student fee 2 25 sufficient to offset the administrative costs incurred by the 2 26 academy for inspecting and certifying the facilities. 2 27 Under current law, only the Iowa law enforcement academy or 2 28 a governmental agency facility recognized pursuant to Code 2 29 section 80B.11, subsection 8, may provide law enforcement 2 30 training. 2 31 LSB 5601HT 79 2 32 jm/cls/14
