  1  1    Sec. 1.  Section 331.438, subsection 2, paragraph b, Code
  1  2 Supplement 2001, is amended to read as follows:
  1  3    b.  A county's portion of the allowed growth factor
  1  4 adjustment appropriation for a fiscal year shall be determined
  1  5 based upon the county's proportion of the state's general
  1  6 population.  In order to be eligible to receive the county's
  1  7 portion of that appropriation, the county must levy for the
  1  8 fiscal year the maximum levy amount allowed for the county's
  1  9 services fund.  An ineligible county's portion of the
  1 10 appropriation shall be divided among the eligible counties
  1 11 based upon an eligible county's proportion of the total
  1 12 general population of the eligible counties.
  1 13    Sec. 2.  APPLICABILITY – TRANSITION.
  1 14    1.  Section 331.438, as amended by this Act, is first
  1 15 applicable to county levies for the fiscal year beginning July
  1 16 1, 2003.
  1 17    2.  For the fiscal year beginning July 1, 2002, and ending
  1 18 June 30, 2003, in order for a county to be eligible for the
  1 19 county's portion of the allowed growth factor adjustment
  1 20 appropriation distributed for that fiscal year in accordance
  1 21 with section 331.438, the county must levy for the fiscal year
  1 22 at least seventy percent of the maximum levy amount allowed
  1 23 for the county's mental health, mental retardation, and
  1 24 developmental disabilities services fund under section
  1 25 331.424A.  For that fiscal year, an ineligible county's
  1 26 portion shall be divided among the eligible counties based
  1 27 upon an eligible county's proportion of total general
  1 28 population of the eligible counties.  
  1 29                           EXPLANATION
  1 30    This bill relates to county eligibility for state payment
  1 31 of the allowed growth factor adjustment for county mental
  1 32 health, mental retardation, and developmental disabilities
  1 33 (MH/MR/DD) services.
  1 34    Current law limits the maximum levy for a county's MH/MR/DD
  1 35 services fund to a base year expenditure amount less the state
  2  1 property tax relief payment amount to be received by the
  2  2 county.  The law provides for state payment of an allowed
  2  3 growth adjustment amount to address increased costs.  The bill
  2  4 conditions a county's eligibility for the county's portion of
  2  5 the state's allowed growth adjustment appropriation on the
  2  6 county levying the maximum amount allowed for the MH/MR/DD
  2  7 services fund.  This eligibility condition is first applicable
  2  8 to levies for fiscal year 2003-2004.
  2  9    For fiscal year 2002-2003, a county must levy at least 70
  2 10 percent of the maximum amount allowed for the county's
  2 11 MH/MR/DD services fund in order to be eligible to receive the
  2 12 county's portion of the allowed growth appropriation.
  2 13    If a county does not meet the eligibility requirement, an
  2 14 ineligible county's portion of the appropriation is to be
  2 15 divided among the eligible counties.
