  1  4 PROVIDING FOR A WELL-BEING VISIT TO BE CONDUCTED ON AN
  1  5    OPTIONAL BASIS UNDER A FAMILY INVESTMENT PROGRAM LIMITED
  1  6    BENEFIT PLAN AND PROVIDING AN EFFECTIVE DATE.

  1  8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  9 
  1 10    Section 1.  Section 239B.9, subsection 5, Code 2001, is
  1 11 amended to read as follows:
  1 12    5.  WELL-BEING VISIT.  If a participant has chosen a
  1 13 subsequent limited benefit plan, the department may conduct a
  1 14 well-being visit or contract for a well-being visit to be
  1 15 conducted, provided funding is available for the costs of such
  1 16 visits.  A well-being visit shall meet all of the following
  1 17 criteria:
  1 18    a.  a A qualified professional shall attempt to visit with
  1 19 the participant family with a focus upon the children's well-
  1 20 being.
  1 21    b.  The visit shall be performed conducted during or within
  1 22 four weeks of the second month of the start of the subsequent
  1 23 limited benefit plan.
  1 24    c.  The visit shall serve as an extension of the family
  1 25 investment program and the family investment agreement
  1 26 philosophy of supporting families as they move toward self-
  1 27 sufficiency.  The department may contract for the visit.
  1 28    Sec. 2.  CONTRACT TERMINATION.  Effective April 1, 2002,
  1 29 the department of human services shall terminate its contract
  1 30 with the Iowa department of health for conducting well-being
  1 31 visits under section 239B.9, subsection 5, as in effect upon
  1 32 the effective date of this Act.
  1 33    Sec. 3.  EMERGENCY RULES.  The department of human services
  1 34 may adopt emergency rules under section 17A.4, subsection 2,
  1 35 and section 17A.5, subsection 2, paragraph "b", to implement
  2  1 the provisions of this Act and the rules shall be effective
  2  2 immediately upon filing unless a later date is specified in
  2  3 the rules.  Any rules adopted in accordance with this section
  2  4 shall also be published as a notice of intended action as
  2  5 provided in section 17A.4.
  2  6    Sec. 4.  EFFECTIVE DATE.  This Act, being deemed of
  2  7 immediate importance, takes effect upon enactment.
