1 1 Section 1. Section 476.29, subsection 14, Code 2001, is
1 2 amended to read as follows:
1 3 14. This section does not prevent the board from adopting
1 4 rules requiring or allowing local exchange utilities to
1 5 provide extended area service or adjacent exchange service.
1 6 However, such rules shall provide that a simple majority of
1 7 the customers returning ballots pursuant to an extended area
1 8 service survey is all that shall be required for approval or
1 9 discontinuance of extended area service.
1 10 EXPLANATION
1 11 This bill amends Code section 476.29, regarding
1 12 certificates for the provision of local exchange service for
1 13 telecommunications. The bill requires that any rules adopted
1 14 by the utilities board pertaining to extended area service
1 15 shall require only a simple majority of the customers
1 16 returning ballots for approval or discontinuance of such
1 17 service areas. Current administrative rules 199 IAC 22.8(3)
1 18 and 22.8(5) require 65 percent of the customers returning
1 19 ballots to vote in favor of approval or discontinuance of
1 20 extended area service.
