  1  1    Section 1.  Section 455B.173, Code 2001, is amended by
  1  2 adding the following new subsection:
  1  3    NEW SUBSECTION.  14.  Adopt rules relating to the awarding
  1  4 of financial assistance pursuant to section 455B.196.
  1  5    Sec. 2.  NEW SECTION.  455B.196  PRELIMINARY ENGINEERING
  1  6 ASSISTANCE FUND.
  1  7    1.  A preliminary engineering assistance fund is created in
  1  8 the state treasury under the control of the department and
  1  9 consisting of any moneys appropriated by the general assembly
  1 10 and any other moneys available to and obtained or accepted by
  1 11 the department for placement in the fund.  Payments of
  1 12 interest, repayments of moneys loaned pursuant to this
  1 13 section, and recaptures of loans shall be deposited in the
  1 14 fund.  Moneys in the fund are not subject to section 8.33.
  1 15 Notwithstanding section 12C.7, interest or earnings on moneys
  1 16 in the fund shall be credited to the fund.
  1 17    2.  Moneys in the preliminary engineering assistance fund
  1 18 are appropriated to the department for purposes of providing
  1 19 financial assistance to communities in the form of grants,
  1 20 loans, forgivable loans, loan guarantees, and other forms of
  1 21 assistance to aid the communities in the financing of a
  1 22 preliminary engineering study to explore alternative
  1 23 wastewater treatment and disposal systems for the applicant
  1 24 community.
  1 25    3.  In order to qualify to apply for financial assistance,
  1 26 an applicant must meet all of the following criteria:
  1 27    a.  The applicant must be a city with a population of less
  1 28 than five hundred or an unincorporated community with a
  1 29 population of less than five hundred.
  1 30    b.  The applicant must have either an inadequate
  1 31 centralized waste collection and treatment system or
  1 32 collection of private waste collection systems that may be
  1 33 inadequate to meet the needs of the applicant community.  
  1 34                           EXPLANATION
  1 35    This bill relates to financial assistance for preliminary
  2  1 engineering studies for alternative wastewater treatment and
  2  2 disposal systems.
  2  3    The bill creates a preliminary engineering assistance fund
  2  4 under the control of the department of natural resources.  The
  2  5 bill provides that moneys in the preliminary engineering
  2  6 assistance fund are appropriated to the department for
  2  7 purposes of providing financial assistance to certain
  2  8 qualifying communities for preliminary engineering studies to
  2  9 explore alternative wastewater treatment and disposal systems
  2 10 for the applicant community.  The bill provides that, in order
  2 11 to qualify to apply for financial assistance, an applicant
  2 12 must either be a city with a population of less than 500 or an
  2 13 unincorporated community with a population of less than 500
  2 14 and the applicant must have either an inadequate centralized
  2 15 waste collection and treatment system or collection of private
  2 16 waste collection systems that may be inadequate to meet the
  2 17 needs of the applicant community.
