1 1 Section 1. Section 141A.8, subsection 1, Code Supplement
1 2 2001, is amended by adding the following new paragraph:
1 3 NEW PARAGRAPH. d. Notwithstanding any other provision of
1 4 law to the contrary, a care provider may transmit cautions
1 5 regarding HIV information in the course of the care provider's
1 6 duties over the police radio broadcasting system under chapter
1 7 693 or any other radio-based communications system, if the
1 8 information transmitted does not personally identify an
1 9 individual.
1 10 EXPLANATION
1 11 This bill adds a provision to the acquired immune
1 12 deficiency syndrome (AIDS) chapter (Code chapter 141A) to
1 13 allow a care provider, in the course of the care provider's
1 14 duties, to transmit cautions regarding HIV information over
1 15 radio-based communications, if the information transmitted
1 16 does not personally identify an individual. A care provider
1 17 is defined as a person trained and authorized by federal or
1 18 state law to provide health care services in the course of the
1 19 individual's official duties, for compensation or voluntarily,
1 20 who is a health care provider, emergency medical care
1 21 provider, fire fighter or peace officer. "Care provider" also
1 22 includes an individual who renders emergency care or
1 23 assistance in an emergency or due to an accident. A similar
1 24 provision currently exists under the communicable and
1 25 infectious diseases and poisonings chapter (Code chapter 139).
