PAG LIN 1 1 Section 1. Section 347.9, Code Supplement 2001, is amended 1 2 to read as follows: 1 3 347.9 TRUSTEES APPOINTMENT TERMS OF OFFICE. 1 4 When it has been determined by the voters of a county to 1 5 establish a county public hospital, the board shall appoint 1 6 seven trustees chosen from among the resident citizens of the 1 7 county with reference to their fitness for office, and not 1 8 more than four of the trustees shall be residents of the city 1 9 at which the hospital is located. The trustees shall hold 1 10 office until the following general election, at which time 1 11 their successors shall be elected, two for a term of two 1 12 years, two for four years, and three for six years, and they 1 13 shall determine by lot their respective terms, and thereafter 1 14 their successors shall be elected for regular terms of six 1 15 years each. A person or spouse of a person with medical or 1 16 special staff privileges in the county public hospital or who 1 17 receives direct or indirect compensation in an amount greater 1 18 than one thousand five hundred dollars in a calendar year from 1 19 the county public hospital or direct or indirect compensation 1 20 in an amount greater than one thousand five hundred dollars in 1 21 a calendar year from a person contracting for services with 1 22 the hospital shall not be eligible to serve as a trustee for 1 23 that county public hospital. However, this section does not 1 24 prohibit a licensed health care practitioner from serving as a 1 25 hospital trustee if the practitioner's sole use of the county 1 26 hospital is to provide health care service to an individual 1 27 with mental retardation as defined in section 222.2. In 1 28 addition, in counties having a population of less than fifteen 1 29 thousand, this section does not prohibit a person from serving 1 30 as a county hospital trustee if the person's spouse is an 1 31 emergency medical care provider as defined in section 147A.1 1 32 at that county hospital. 1 33 EXPLANATION 1 34 This bill provides that, in counties having a population of 1 35 less than 15,000, a person is not prohibited from serving as a 2 1 county hospital trustee if the person's spouse is an emergency 2 2 medical care provider as defined in Code section 147A.1 at 2 3 that county hospital. 2 4 LSB 5031HH 79 2 5 tj/pj/5
