1 1 Section 1. Section 232.2, subsection 6, Code Supplement
1 2 2001, is amended by adding the following new paragraph:
1 3 NEW PARAGRAPH. bb. Whose parent, guardian, or other
1 4 member of the household in which the child resides has
1 5 committed domestic abuse assault, as defined in section
1 6 708.2A, in the child's presence, within the past six months,
1 7 and, as a result of the domestic abuse assault, the child has
1 8 suffered physical injury or emotional damage.
1 9 EXPLANATION
1 10 This bill applies child in need of assistance and domestic
1 11 abuse assault provisions to a child whose parent, guardian, or
1 12 other member of the household in which the child resides has
1 13 committed domestic abuse assault in the child's presence.
1 14 Code section 232.2, relating to the definition of child in
1 15 need of assistance, is amended to include an unmarried child
1 16 in whose presence the parent, guardian, or other member of the
1 17 household in which the child resides has committed domestic
1 18 abuse assault, as defined in Code section 708.2A, in the past
1 19 six months, and, as a result of the domestic abuse assault,
1 20 the child has suffered physical injury or emotional damage.
