1 1 Section 1. Section 422.45, Code Supplement 2001, is
1 2 amended by adding the following new subsection:
1 3 NEW SUBSECTION. 63. The gross receipts from services
1 4 rendered, furnished, or performed for the production of master
1 5 audio, video, film, or digital recordings or similar media.
1 6 Sec. 2. REFUNDS. Refunds of taxes, interest, or penalties
1 7 which arise from claims resulting from the enactment of
1 8 section 422.45, subsection 63, in this Act, for sales
1 9 occurring between January 1, 1994, and the effective date of
1 10 this Act, shall be limited to twenty-five thousand dollars in
1 11 the aggregate and shall not be allowed unless refund claims
1 12 are filed prior to October 1, 2002, notwithstanding any other
1 13 provision of law. If the amount of claims totals more than
1 14 twenty-five thousand dollars in the aggregate, the department
1 15 of revenue and finance shall prorate the twenty-five thousand
1 16 dollars among all claimants in relation to the amounts of the
1 17 claimants' valid claims.
1 18 Sec. 3. EFFECTIVE DATE AND RETROACTIVE APPLICABILITY
1 19 PROVISION. This Act, being deemed of immediate importance,
1 20 takes effect upon enactment and applies retroactively to
1 21 January 1, 1994.
1 22 EXPLANATION
1 23 This bill exempts from state sales and use taxes the
1 24 providing of services for the production of master audio,
1 25 video, film, or digital recordings or similar media. The bill
1 26 takes effect upon enactment and applies retroactively to
1 27 January 1, 1994. Because of the retroactive applicability
1 28 provision, refunds of any taxes are limited to $25,000.
