1 1 Section 1. Section 481B.3, Code 2001, is amended by
1 2 striking the section and inserting in lieu thereof the
1 3 following:
1 4 481B.3 STATE LIST.
1 5 1. The commission shall adopt rules pursuant to chapter
1 6 17A to establish the means by which the department shall
1 7 determine if a species shall be proposed for listing as
1 8 threatened or endangered within the state. To the extent
1 9 possible, the rules shall be patterned after the regulations
1 10 in effect on January 1, 2000, as adopted by the United States
1 11 fish and wildlife service for determining lists of threatened
1 12 or endangered species for the nation.
1 13 2. The commission shall adopt rules pursuant to chapter
1 14 17A for proposing the listing of those species of fish,
1 15 plants, and wildlife which are determined to be threatened or
1 16 endangered within the state pursuant to subsection 1. The
1 17 rules shall include provisions for a person to petition the
1 18 commission for the addition or removal of a species from the
1 19 lists.
1 20 3. Except for species also listed as threatened or
1 21 endangered by the United States fish and wildlife service as
1 22 of July 1, 2001, the species listed by the department as
1 23 threatened or endangered which were not determined to be
1 24 threatened or endangered pursuant to the rules adopted
1 25 pursuant to this section are removed from the lists.
1 26 EXPLANATION
1 27 This bill directs the natural resource commission of the
1 28 department of natural resources to adopt rules pursuant to
1 29 Code chapter 17A to establish the means by which species shall
1 30 be proposed for listing as threatened or endangered within the
1 31 state. The rules are to be patterned after the regulations in
1 32 effect on January 1, 2000, as adopted by the United States
1 33 fish and wildlife service to determine lists of threatened and
1 34 endangered species for the nation. The natural resource
1 35 commission is directed to adopt rules for proposing the
2 1 species of fish, plants, and wildlife that are determined to
2 2 be threatened or endangered within the state. The rules are
2 3 to include provisions for allowing persons to propose
2 4 additions or deletions from the lists.
2 5 The bill also provides that except for species also listed
2 6 as threatened or endangered by the United States fish and
2 7 wildlife service as of July 1, 2001, the species currently
2 8 listed by the department as threatened or endangered which
2 9 were not determined to be threatened or endangered pursuant to
2 10 the rules adopted pursuant to the bill shall be removed from
2 11 the lists of threatened and endangered species.
