  1  4 RELATING TO THE ESTABLISHMENT OF A TASK FORCE TO DEVELOP AN
  1  5    INTERSTATE PRESCRIPTION DRUG PURCHASING COOPERATIVE.

  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  8 
  1  9    Section 1.  INTERSTATE PRESCRIPTION DRUG PURCHASING
  1 10 COOPERATIVE – TASK FORCE – REPORT.
  1 11    1.  The Iowa department of public health shall convene a
  1 12 task force to determine the feasibility of establishing an
  1 13 interstate prescription drug purchasing cooperative with other
  1 14 midwestern states.
  1 15    2.  The task force shall consist of all of the following
  1 16 voting members:
  1 17    a.  The director of public health, or the director's
  1 18 designee.
  1 19    b.  The director of human services, or the director's
  1 20 designee.
  1 21    c.  The director of the department of elder affairs, or the
  1 22 director's designee.
  1 23    d.  The director of the department of management, or the
  1 24 director's designee.
  1 25    e.  The director of the department of personnel, or the
  1 26 director's designee.
  1 27    f.  Four members of the general assembly.
  1 28    3.  a.  The legislative members of the task force shall be
  1 29 appointed by the majority leader of the senate, after
  1 30 consultation with the president of the senate and the minority
  1 31 leader of the senate, and by the speaker of the house of
  1 32 representatives, after consultation with the majority leader
  1 33 and the minority leader of the house of representatives.  The
  1 34 legislative appointments shall comply with sections 69.16 and
  1 35 69.16A.
  2  1    b.  Vacancies on the task force shall be filled by the
  2  2 original appointing authority and in the manner of the
  2  3 original appointments.
  2  4    4.  The task force shall elect a chairperson.  A majority
  2  5 of the members of the task force shall constitute a quorum.  A
  2  6 majority vote of those members present shall be required for
  2  7 any action of the task force.  The Iowa department of public
  2  8 health and the department of human services shall cooperate in
  2  9 providing staffing for the task force.
  2 10    5.  All of the following shall act as advisors to the task
  2 11 force:
  2 12    a.  The chairperson of the board of pharmacy examiners, or
  2 13 the chairperson's designee.
  2 14    b.  The chairperson of the board of medical examiners, or
  2 15 the chairperson's designee.
  2 16    c.  One person who is a representative of pharmaceutical
  2 17 manufacturers, selected by the pharmaceutical research and
  2 18 manufacturers of America.
  2 19    d.  One person who is a representative of the Iowa pharmacy
  2 20 association, selected by the Iowa pharmacy association.
  2 21    e.  One person who is a representative of the Iowa medical
  2 22 society, selected by the Iowa medical society.
  2 23    6.  The task force shall pursue the development of an
  2 24 interstate prescription drug purchasing cooperative through a
  2 25 minimum of the following means:
  2 26    a.  Utilizing regional and national entities such as the
  2 27 council of state governments, the national conference of state
  2 28 legislatures, and others in establishing contact with the
  2 29 governors and legislative leaders of other midwestern states.
  2 30    b.  Contacting the governors and legislative leaders of
  2 31 other states with existing interstate cooperatives, including
  2 32 the states participating in the southern states coalition
  2 33 purchasing pool, and other interstate cooperatives.
  2 34    c.  Contacting industry trade associations whose members
  2 35 are involved in the delivery and reimbursement of state-funded
  3  1 pharmaceutical care.
  3  2    7.  The task force shall submit bimonthly progress reports
  3  3 of its findings and recommendations regarding the
  3  4 establishment of an interstate prescription drug purchasing
  3  5 cooperative to the oversight committee of the legislative
  3  6 council.  The task force shall also submit a final report of
  3  7 its findings and recommendations to the governor and the
  3  8 general assembly no later than December 15, 2002.
