  1  1    Section 1.  Section 262.9, Code Supplement 2001, is amended
  1  2 by adding the following new subsection:
  1  3    NEW SUBSECTION.  29.  a.  Adopt rules that require an
  1  4 institution of higher learning under its control to waive the
  1  5 institution's tuition charges for any undergraduate student
  1  6 who is a resident of Iowa and meets any of the following
  1  7 criteria:
  1  8    (1)  Is the child of a peace officer, as defined in section
  1  9 97A.1, who is killed in the line of duty as determined by the
  1 10 board of trustees of the Iowa department of public safety
  1 11 peace officers' retirement, accident, and disability system in
  1 12 accordance with section 97A.6, subsection 16.
  1 13    (2)  Is the child of an individual in a protection
  1 14 occupation, as defined in section 97B.49B, or is the child of
  1 15 a sheriff, deputy sheriff, or an airport fire fighter, as
  1 16 defined in section 97B.49C, who is killed in the line of duty
  1 17 as determined by the department of personnel in accordance
  1 18 with section 97B.52, subsection 2.
  1 19    (3)  Is the child of a volunteer emergency services
  1 20 provider, as defined in section 100B.11, who is killed in the
  1 21 line of duty as determined by department of public safety in
  1 22 accordance with section 100B.11, subsection 2.
  1 23    (4)  Is the child of a police officer or a fire fighter, as
  1 24 defined in section 411.1, who is killed in the line of duty as
  1 25 determined by the statewide fire and police retirement system
  1 26 in accordance with section 411.6, subsection 15.
  1 27    b.  An individual who is eligible for a waiver under
  1 28 paragraph "a" shall complete and file an application, with an
  1 29 institution of higher learning under the board's control, for
  1 30 a waiver for the ensuing academic year on a form approved by
  1 31 the board.
  1 32    c.  For purposes of this section, "child" includes only a
  1 33 child who is under the age of thirty years and is a full-time
  1 34 student.  
  1 35                           EXPLANATION
  2  1    This bill requires the state board of regents to adopt
  2  2 rules directing its institutions of higher learning to waive
  2  3 undergraduate tuition charges for the children of peace and
  2  4 police officers, fire fighters, sheriffs, deputies, volunteer
  2  5 emergency services providers, and individuals in protection
  2  6 occupations killed in the line of duty.
  2  7    Eligible individuals must apply to the institutions for a
  2  8 waiver.
