PAG LIN 1 1 Section 1. Section 479.44, Code 2001, is amended to read 1 2 as follows: 1 3 479.44 NEGOTIATED FEE. 1 4 1. An easement agreement between a pipeline company and a 1 5 landowner for purposes of the construction, maintenance, or 1 6 operation of a pipeline shall require a one-time lump sum 1 7 payment for the easement prior to beginning the construction, 1 8 maintenance, or operation. 1 9 2. In lieu of a one-time lump sum payment for an easement 1 10 or other property interest allowing a pipeline to cross the 1 11 property, a landowner and the pipeline company may negotiate 1 12 an annual fee, to be paid over a fixed number of years. 1 13 Unless the easement provides otherwise, the annual fee shall 1 14 run with the land and shall be payable to the owner of record. 1 15 Sec. 2. Section 479A.23, Code 2001, is amended to read as 1 16 follows: 1 17 479A.23 NEGOTIATEDANNUALFEE. 1 18 1. Unless the 2 7 easement provides otherwise, the annual fee shall run with the 2 8 land and shall be payable to the owner of record. 2 9 EXPLANATION 2 10 This bill relates to negotiated fees for easement 2 11 agreements between pipeline companies and landowners for 2 12 intrastate pipelines, interstate natural gas pipelines, and 2 13 interstate hazardous liquid pipelines.
