  1  1    Section 1.  Section 89A.3, subsection 5, Code 2001, is
  1  2 amended to read as follows:
  1  3    5.  The commissioner may shall adopt rules permitting
  1  4 inclined or vertical wheelchair lifts and residential
  1  5 elevators in churches and houses of worship to service more
  1  6 than one floor.  
  1  7                              EXPLANATION
  1  8    This bill requires the labor commissioner to adopt rules
  1  9 permitting wheelchair lifts and residential elevators in
  1 10 churches.  Under current law, the labor commissioner is
  1 11 allowed, but not required, to adopt rules permitting
  1 12 wheelchair lifts in churches.
