PAG LIN 1 1 HOUSE FILE 2112 1 2 1 3 AN ACT 1 4 REQUIRING MOTOR VEHICLE OPERATORS TO TAKE CERTAIN PRECAUTIONS 1 5 WHEN PASSING STATIONARY AUTHORIZED EMERGENCY, TOWING, 1 6 RECOVERY, AND HIGHWAY MAINTENANCE VEHICLES AND PROVIDING 1 7 A PENALTY. 1 8 1 9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 10 1 11 Section 1. NEW SECTION. 321.323A APPROACHING CERTAIN 1 12 STATIONARY VEHICLES. 1 13 1. The operator of a motor vehicle approaching a 1 14 stationary authorized emergency vehicle that is displaying 1 15 flashing yellow, amber, white, red, or red and blue lights 1 16 shall approach the authorized emergency vehicle with due 1 17 caution and shall proceed in one of the following manners, 1 18 absent any other direction by a peace officer: 1 19 a. Make a lane change into a lane not adjacent to the 1 20 authorized emergency vehicle if possible in the existing 1 21 safety and traffic conditions. 1 22 b. If a lane change under paragraph "a" would be 1 23 impossible, prohibited by law, or unsafe, reduce the speed of 1 24 the motor vehicle to a reasonable and proper speed for the 1 25 existing road and traffic conditions, which speed shall be 1 26 less than the posted speed limit, and be prepared to stop. 1 27 2. The operator of a motor vehicle approaching a 1 28 stationary towing or recovery vehicle, or a stationary highway 1 29 maintenance vehicle, that is displaying flashing yellow, 1 30 amber, or red lights shall approach the vehicle with due 1 31 caution and shall proceed in one of the following manners, 1 32 absent any other direction by a peace officer: 1 33 a. Make a lane change into a lane not adjacent to the 1 34 towing, recovery, or highway maintenance vehicle if possible 1 35 in the existing safety and traffic conditions. 2 1 b. If a lane change under paragraph "a" would be 2 2 impossible, prohibited by law, or unsafe, reduce the speed of 2 3 the motor vehicle to a reasonable and proper speed for the 2 4 existing road and traffic conditions, which speed shall be 2 5 less than the posted speed limit, and be prepared to stop. 2 6 Sec. 2. Section 805.8A, subsection 11, paragraph b, Code 2 7 Supplement 2001, is amended to read as follows: 2 8 b.
