PAG LIN 1 1 Section 1. Section 321.1, subsection 36A, Code Supplement 1 2 2001, is amended to read as follows: 1 3 36A. "Low-speed vehicle" means a motor vehicle 1 4 manufactured in compliance with or modified to meet the 1 5 national highway and traffic safety administration standards 1 6 for low-speed vehicles in 49 C.F.R. } 571.500. A low-speed 1 7 vehiclewhichthat is in compliance with the equipment 1 8 requirements in 49 C.F.R. } 571.500 shall be deemed to be in 1 9 compliance with all equipment requirements of this chapter. 1 10 Sec. 2. Section 321.20, subsection 2, Code Supplement 1 11 2001, is amended to read as follows: 1 12 2. A description of the vehicle including, insofar as the 1 13 specified data may exist with respect to a given vehicle, the 1 14 make, model, type of body, the number of cylinders, the type 1 15 of motor fuel used, the serial number of the vehicle, 1 16 manufacturer's identification number, the engine or other 1 17 number of the vehicle and whether new or used and if a new 1 18 vehicle the date of sale by the manufacturer or dealer to the 1 19 person intending to operate such vehicle. If the vehicle is a 1 20 new low-speed vehicle, the manufacturer's or importer's 1 21 certificate required to accompany the application under 1 22 subsection 4 shall certify that the vehicle was manufactured 1 23 in compliance with the national highway and traffic safety 1 24 administration standards for low-speed vehicles in 49 C.F.R. } 1 25 571.500. If the vehicle has been modified to operate as a 1 26 low-speed vehicle, the application shall be accompanied by a 1 27 certification from the department that the vehicle meets the 1 28 national highway and traffic safety administration standards 1 29 for low-speed vehicles in 49 C.F.R. } 571.500, as prescribed 1 30 by rule of the department. 1 31 EXPLANATION 1 32 This bill allows a motor vehicle that has been modified to 1 33 meet the national highway and traffic safety administration 1 34 standards for low-speed vehicles to be registered and operated 1 35 as a low-speed vehicle on the highways of this state. 2 1 Currently, a vehicle must be manufactured in compliance with 2 2 the national standards to be so registered and operated. 2 3 The bill requires that an application for registration of a 2 4 modified low-speed vehicle be accompanied by a certification 2 5 from the state department of transportation that the vehicle 2 6 meets the national highway and traffic safety administration 2 7 standards for low-speed vehicles. Currently, compliance with 2 8 the standards is shown by a certification on the 2 9 manufacturer's or importer's certificate required to accompany 2 10 the application for registration of a new low-speed vehicle. 2 11 Iowa law allows low-speed vehicles to be operated on public 2 12 streets with a posted speed limit of 35 miles per hour or 2 13 less. 2 14 LSB 5040HH 79 2 15 nh/sh/8
