1 1 Section 1. NEW SECTION. 455D.22 MOTOR OIL FILTER
1 2 COLLECTION AND RECYCLING.
1 3 1. The department shall develop, in cooperation with
1 4 retailers, distributors, and manufacturers that sell motor oil
1 5 filters, a pilot project in at least four but not more than
1 6 ten counties for the voluntary collection and recycling of
1 7 used motor oil filters. The pilot project must meet both of
1 8 the following objectives:
1 9 a. At least one free collection site for used motor oil
1 10 filters must be located in the county.
1 11 b. Collection is free at all free collection sites to any
1 12 person depositing used motor oil filters.
1 13 2. The pilot project developed by the department for the
1 14 collection and recycling of used motor oil filters must
1 15 include all of the following:
1 16 a. An explanation of the proposed system for collecting
1 17 and recycling used motor oil filters.
1 18 b. A clear assignment of responsibility and accountability
1 19 for implementation.
1 20 c. A strategy for educating the parties responsible for
1 21 implementing the pilot project.
1 22 d. A strategy for educating the public on how to recycle
1 23 used motor oil filters.
1 24 e. A strategy for remaining informed after the
1 25 implementation of the pilot project on issues including but
1 26 not limited to the identities of sites collecting used motor
1 27 oil filters and the number of used motor oil filters
1 28 collected.
1 29 f. A description of the state's role, if any.
1 30 g. Recommendations for legislation or rulemaking, if
1 31 necessary.
1 32 3. The department shall deliver a pilot project plan to
1 33 the commission by January 1, 2003. Upon recommendation of the
1 34 director, the commission shall adopt rules pursuant to chapter
1 35 17A necessary to implement and administer the pilot project.
2 1 The pilot project must be implemented no later than September
2 2 1, 2003.
2 3 EXPLANATION
2 4 This bill requires the department of natural resources to
2 5 develop, in cooperation with retailers, distributors, and
2 6 manufacturers that sell motor oil filters, a pilot project in
2 7 at least four but not more than 10 counties for the collection
2 8 and recycling of used motor oil filters.
2 9 The bill provides that the objectives of the pilot project
2 10 include providing at least one free collection site in the
2 11 county. Collection is free at any free collection site to any
2 12 person depositing used motor oil filters.
2 13 The pilot project must include an explanation of the
2 14 proposed system of collecting and recycling, an assignment of
2 15 responsibility and accountability, a strategy for educating
2 16 the parties responsible for implementing the pilot project, a
2 17 strategy for educating the public, a strategy for remaining
2 18 informed after the implementation of the pilot project, a
2 19 description of the government's role, and recommendations for
2 20 legislation and rulemaking.
2 21 The pilot project plan must be delivered to the
2 22 environmental protection commission by January 1, 2003, and
2 23 implemented no later than September 1, 2003. The commission
2 24 is to adopt, upon recommendation of the director, rules
2 25 pursuant to Code chapter 17A necessary to carry out the pilot
2 26 project.
