  1  1    Section 1.  Section 99B.7, subsection 7, paragraph a, Code
  1  2 2001, is amended to read as follows:
  1  3    a.  Except as provided in this paragraph, a person shall
  1  4 not be compensated for services rendered in connection with a
  1  5 game of skill, game of chance, or raffle conducted under this
  1  6 section.  This section forbids payment of compensation to
  1  7 persons including, but not limited to, managers, callers,
  1  8 cashiers, floor workers, janitorial personnel, accountants and
  1  9 bookkeepers.  The privilege of selling merchandise on the
  1 10 premises during a bingo occasion is deemed to be compensation.
  1 11 However, not more than four persons per one hundred players,
  1 12 participating in the bingo occasion may be employed.  An
  1 13 employee under this paragraph need not be a member of the
  1 14 qualified organization or a regular participant in the
  1 15 activities of the qualified organization or in an educational,
  1 16 civic, public, charitable, patriotic, or religious
  1 17 organization to which the net receipts are dedicated by the
  1 18 qualified organization.  The wages of an employee shall not
  1 19 exceed the federal minimum wage.  This section does not
  1 20 prohibit the employment of one or more individuals to serve as
  1 21 security officers.  A person who knowingly pays or receives
  1 22 compensation in violation of this section subsection commits a
  1 23 fraudulent practice.
  1 24    Sec. 2.  Section 99B.7, Code 2001, is amended by adding the
  1 25 following new subsection:
  1 26    NEW SUBSECTION.  9.  A qualified organization licensed to
  1 27 conduct bingo games may contract with a person to operate one
  1 28 or more concessions during a bingo occasion.  Each concession
  1 29 shall operate independent of the bingo game and under the
  1 30 general supervision of the licensed qualified organization.
  1 31 The provisions of subsection 7 shall not apply to a qualified
  1 32 organization or a concessionaire operating pursuant to this
  1 33 subsection.  
  1 34                           EXPLANATION
  1 35    This bill provides that a qualified organization licensed
  2  1 to conduct bingo games may contract with a person to operate
  2  2 one or more concessions during a bingo occasion.  Each
  2  3 concessionaire shall operate under the general supervision of
  2  4 the licensed qualified organization.
