PAG LIN 1 1 Section 1. Section 124.212, subsection 5, paragraph b, 1 2 unnumbered paragraph 1, Code 2001, is amended to read as 1 3 follows: 1 4TheExcept as provided in section 124.401, subsection 3, 1 5 the following drug products containing ephedrine, its salts, 1 6 optical isomers, and salts of such optical isomers are 1 7 excepted from this schedule if they may lawfully be sold over 1 8 the counter without a prescription under the federal Food, 1 9 Drug and Cosmetic Act; are labeled and marketed in a manner 1 10 consistent with the pertinent over-the-counter tentative final 1 11 or final monograph; are manufactured and distributed for 1 12 legitimate medicinal use in a manner that reduces or 1 13 eliminates the likelihood of abuse; and are not marketed, 1 14 advertised, or labeled for the indication of stimulation, 1 15 mental alertness, weight loss, muscle enhancement, appetite 1 16 control, or energy: 1 17 Sec. 2. Section 124.401, subsection 3, Code 2001, is 1 18 amended by adding the following new unnumbered paragraph: 1 19 NEW UNNUMBERED PARAGRAPH. It is unlawful for any person to 1 20 sell any product containing ephedrine, its salts, optical 1 21 isomers, and salts of such isomers to a person under eighteen 1 22 years of age. Any person who violates this paragraph commits 1 23 a simple misdemeanor. 1 24 Sec. 3. Section 126.5, subsection 5, Code 2001, is amended 1 25 to read as follows: 1 26 5. A violation of this chapter, except for section 126.24, 1 27 is a violation of section 714.16, subsection 2, paragraph "a". 1 28 Sec. 4. NEW SECTION. 126.24 SALE OF CREATININE TO 1 29 PERSONS UNDER EIGHTEEN YEARS OF AGE – PENALTY. 1 30 A person shall not sell creatinine or any compound, 1 31 mixture, or preparation containing creatinine to a person 1 32 under eighteen years of age. A person violating this section 1 33 commits a simple misdemeanor. 1 34 EXPLANATION 1 35 This bill establishes a criminal offense for selling 2 1 certain ephedrine products or creatinine to a person under 18 2 2 years of age. 2 3 Under existing law, a person may lawfully sell to anyone 2 4 certain ephedrine products. This bill provides that a person 2 5 shall not sell certain ephedrine products to a person under 18 2 6 years of age. 2 7 The bill also prohibits the sale of creatinine, or products 2 8 containing creatinine, to a person under 18 years of age. 2 9 A person who commits a violation of this bill commits a 2 10 simple misdemeanor. A simple misdemeanor is punishable by 2 11 confinement for no more than 30 days or a fine of at least $50 2 12 but not more than $500 or both. 2 13 LSB 5398HH 79 2 14 jm/cf/24
