1 4 RELATING TO THE APPLICATION OF SALES AND SERVICES TAX RECEIPTS
1 5 BY A POLITICAL SUBDIVISION TO THE PAYMENT OF PRINCIPAL AND
1 6 INTEREST OF CERTAIN BONDS.

1 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 10 Section 1. Section 76.4, Code 2001, is amended to read as
1 11 follows:
1 12 76.4 PERMISSIVE APPLICATION OF FUNDS.
1 13 Whenever the governing authority of such political
1 14 subdivision shall have on hand funds derived from any other
1 15 source than taxation which may be appropriated to the payment
1 16 either of interest or principal, or both principal and
1 17 interest of such bonds, such funds may be so appropriated and
1 18 used and the levy for the payment of the bonds correspondingly
1 19 reduced. This section shall not restrict the authority of a
1 20 political subdivision to apply sales and services tax receipts
1 21 collected pursuant to chapter 422B for such purpose.
1 22 Notwithstanding section 422E.1, subsection 3, a school
1 23 district may apply local sales and services tax receipts
1 24 collected pursuant to chapter 422E for the purposes of this
1 25 section.
