1 1 Section 1. NEW SECTION. 317.27 WEED-FREE CERTIFICATION
1 2 PROGRAM.
1 3 1. The board of supervisors for a county that has
1 4 appointed a county weed commissioner may adopt an ordinance
1 5 providing for a weed-free certification program for forage or
1 6 mulch as provided in this section. The purposes of the
1 7 program are to limit the spread of noxious seeds, noxious
1 8 weeds, and undesirable plants and to increase markets for
1 9 weed-free forage or mulch.
1 10 2. An ordinance adopted by a county board of supervisors
1 11 and any related policy adopted by a county weed commissioner
1 12 shall conform with rules which shall be adopted by the state
1 13 weed commissioner. The state weed commissioner shall adopt
1 14 rules listing noxious weed seeds, noxious weeds and
1 15 undesirable plants; establishing management and treatment
1 16 practices; establishing inspection procedures; and providing
1 17 for documentation related to certification, including transit
1 18 forms, markings, or tags. The list shall at least include
1 19 primary and noxious weed seeds as defined in section 199.1 and
1 20 primary and secondary noxious weeds as defined in section
1 21 317.1A. The department may publish the forms or set forth
1 22 requirements for such forms to be published by the county weed
1 23 commissioner. The rules may also require that county weed
1 24 commissioners attend continuing education courses in order to
1 25 administer the program. The rules shall to every extent
1 26 practicable be based on programs administered in other states,
1 27 requirements of federal agencies as provided in section 7
1 28 U.S.C. } 2814, and recommendations of interested organizations
1 29 proposing regional forage certification standards.
1 30 3. The state weed commissioner, in cooperation with Iowa
1 31 state university, other state or federal agencies, or
1 32 interested organizations, may conduct continuing educational
1 33 courses for county weed commissioners as required in order to
1 34 administer this section.
1 35 4. For the purpose of obtaining revenue to defray the
2 1 costs of administering the provisions of this section, the
2 2 county board of supervisors may establish fees required for
2 3 certification, and the department of agriculture and land
2 4 stewardship and Iowa state university may establish fees for
2 5 conducting continuing education courses. All moneys received
2 6 by the department or Iowa state university shall be handled in
2 7 the same manner as repayment receipts, as defined in section
2 8 8.2, and shall be used solely for the administration and
2 9 enforcement of this section.
2 10 EXPLANATION
2 11 This bill provides for a weed-free certification program
2 12 for forage or mulch. A board of supervisors for a county that
2 13 has appointed a county weed commissioner may adopt an
2 14 ordinance providing for the program. The department of
2 15 agriculture and land stewardship (and specifically the state
2 16 weed commissioner) must adopt rules listing noxious weed
2 17 seeds, noxious weeds and undesirable plants; establishing
2 18 management and treatment practices; and establishing
2 19 inspection procedures; and documentation related to
2 20 certification. The rules may also require that county weed
2 21 commissioners attend continuing education courses. The rules
2 22 shall to every extent practicable be based on programs

2 24 agencies, and recommendations of interested organizations.
2 25 The bill provides that the county board of supervisors may
2 26 establish fees required for certification, and the department
2 27 of agriculture and land stewardship and Iowa state university
