1 1 Section 1. Section 708.13, Code 2001, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 4. A person who disarms or attempts to
1 4 disarm a peace officer and who assaults the peace officer with
1 5 the dangerous weapon commits a class "C" felony.
1 6 EXPLANATION
1 7 This bill relates to the crime of disarming a peace
1 8 officer. The bill provides that if a person disarms a peace
1 9 officer of a dangerous weapon, and subsequently commits any
1 10 assault upon the officer with the weapon, the person commits a
1 11 class "C" felony.
1 12 A class "C" felony is punishable by confinement for no more
1 13 than 10 years and a fine of at least $1,000 but not more than
1 14 $10,000.
