1 1 Section 1. NEW SECTION. 144D.1 DEFINITIONS.
1 2 For the purposes of this chapter:
1 3 1. "Health care provider" means any of the following, and
1 4 includes any officer, employee, or agent of the following:
1 5 a. An individual licensed under chapter 148, 148A, 148B,
1 6 148C, 148D, 148E, 149, 150, 150A, 151, 152, 152A, 152B, 152C,
1 7 152D, 153, 154, 154A, 154B, 154C, 154D, or 155A, or any
1 8 individual who provides health care services under the
1 9 authorization of the licensee.
1 10 b. An institutional health facility as defined in section
1 11 135.61.
1 12 c. Any other individual or facility providing health care
1 13 services to an individual.
1 14 2. "Medical information" means any information regarding a
1 15 patient, including the patient's identity, that is given by
1 16 the patient to the health care provider, or that is recorded
1 17 by the health care provider about the patient in the course of
1 18 providing health care services.
1 19 Sec. 2. NEW SECTION. 144D.2 MEDICAL INFORMATION
1 20 PROPERTY OF PATIENT.
1 21 1. Medical information contained in medical records in the
1 22 possession of any health care provider is the property of the
1 23 patient.
1 24 2. The patient is entitled upon request to a copy of the
1 25 medical records containing the medical information of the
1 26 patient. The health care provider may charge a reasonable fee
1 27 for making the copy.
1 28 Sec. 3. NEW SECTION. 144D.3 USE OF MEDICAL INFORMATION
1 29 FOR MARKETING PROHIBITED.
1 30 1. Release, sales, or use of medical information for the
1 31 purpose of sales or marketing of services or products is
1 32 prohibited.
1 33 2. A person shall not use medical information that is
1 34 released, sold, or otherwise obtained in violation of this
1 35 section for sales or marketing of services or products.
2 1 EXPLANATION
2 2 This bill creates a new Code chapter relating to the use of
2 3 individual medical information.
2 4 New Code section 144D.2 provides that medical information
2 5 contained in medical records in the possession of any health
2 6 care provider is the property of the patient. The patient is
2 7 entitled to a copy of the medical record, and the health care
2 8 provider may charge a reasonable fee for such copy.
2 9 New Code section 144D.3 prohibits the release or use of
2 10 medical information for the purpose of sales or marketing of
2 11 services or products. Code section 144D.3 also prohibits any
2 12 person from using medical information, obtained in violation
2 13 of the section, to sell or market services or products.
2 14 The bill also defines "medical information" and "health
2 15 care provider" in new Code section 144D.1.
