1 1 Section 1. Section 903.1, subsection 2, Code 2001, is
1 2 amended to read as follows:
1 3 2. When a person is convicted of an aggravated
1 4 misdemeanor, and a specific penalty is not provided for, the
1 5 maximum penalty shall be imprisonment not to exceed two years.
1 6 There shall be a fine of at least five hundred dollars but not
1 7 to exceed five thousand dollars, which fine shall not be
1 8 suspended by the court. When a judgment of conviction of an
1 9 aggravated misdemeanor is entered against any person and the
1 10 court imposes a sentence of confinement for a period of more
1 11 than one year the term shall be an indeterminate term.
1 12 EXPLANATION
1 13 This bill relates to the imposition of a fine for a
1 14 criminal offense classified as an aggravated misdemeanor. The
1 15 bill provides that the court shall not suspend a fine imposed
1 16 in an aggravated misdemeanor offense. An aggravated
1 17 misdemeanor is punishable by confinement for no more than two
1 18 years and a fine of at least $500 but not more than $5,000.
