1 1 Section 1. Section 483A.8, subsection 3, Code 2001, is
1 2 amended to read as follows:
1 3 3. A nonresident hunting deer is required to have a
1 4 nonresident deer license and must pay the wildlife habitat
1 5 fee. The commission shall annually limit to seven thousand
1 6 five hundred licenses the number of nonresidents allowed to
1 7 have deer hunting licenses. Of the first six thousand
1 8 nonresident deer licenses issued, not more than thirty-five
1 9 percent of the licenses shall be bow season licenses and,
1 10 after the first six thousand nonresident deer licenses have
1 11 been issued, all additional licenses shall be issued for
1 12 antlerless deer only. However, upon application containing
1 13 proof of ownership of agricultural land in this state and the
1 14 payment of applicable fees, the department shall issue a
1 15 nonresident deer hunting license to the applicant. Deer
1 16 hunting licenses issued to nonresidents who own agricultural
1 17 land in this state are exempt from the limitations and
1 18 allocations specified in this subsection. The number of
1 19 nonresident deer hunting licenses shall be determined as
1 20 provided in section 481A.38. The commission shall allocate
1 21 the nonresident deer hunting licenses issued among the zones
1 22 based on the populations of deer. However, a nonresident
1 23 applicant may request one or more hunting zones, in order of
1 24 preference, in which the applicant wishes to hunt. If the
1 25 request cannot be fulfilled, the applicable fees shall be
1 26 returned to the applicant. A nonresident applying for a deer
1 27 hunting license must exhibit proof of having successfully
1 28 completed a hunter safety and ethics education program as
1 29 provided in section 483A.27 or its equivalent as determined by
1 30 the department before the license is issued.
1 31 EXPLANATION
1 32 This bill provides that upon application with proof of
1 33 ownership of agricultural land in this state and the payment
1 34 of applicable fees, the department shall issue a nonresident
1 35 deer hunting license to the applicant. The deer hunting
2 1 licenses issued to nonresidents who own agricultural land in
2 2 this state are exempt from the limitations and allocations
2 3 applied to nonresident deer hunting licenses in general.
2 4 These limitations and allocations include an annual limit of
2 5 7,500 total licenses and of the first 6,000 licenses issued,
2 6 not more than 35 percent shall be bow season licenses and,
2 7 after the first 6,000 are issued, the remainder shall be
2 8 issued for antlerless deer only.
