1 1 Section 1. Section 96.4, subsection 4, Code 2001, is
1 2 amended by adding the following new unnumbered paragraph after
1 3 unnumbered paragraph 1:
1 4 NEW UNNUMBERED PARAGRAPH. If an individual does not have
1 5 sufficient qualifying wages in the base period to qualify for
1 6 benefits rights, the individual's base period shall be the
1 7 four most recently completed calendar quarters preceding the
1 8 first day of the individual's benefit year. Such base period
1 9 shall be known as the alternate base period. If information
1 10 as to wages for the most recent quarter of the alternate base
1 11 period is not available to the director from the regular
1 12 quarterly reports of wage information that are systematically
1 13 accessible, the director may base the determination of
1 14 eligibility for benefits on the affidavit of the claimant that
1 15 states the name and address of the employer for whom the
1 16 claimant performed services and the claimant's written
1 17 statement of the reason for separation from the employer and
1 18 of wages for that calendar quarter. The claimant shall
1 19 furnish payroll documentation, where available, in support of
1 20 the affidavit. The determination based upon the alternate
1 21 base period as it relates to the claimant's benefits, shall be
1 22 amended when the quarterly report of wage information from the
1 23 employer is timely received and that information causes a
1 24 change in the determination. Any benefits paid and charged to
1 25 an employer's account, based upon a claimant's affidavit,
1 26 shall be adjusted effective as of the beginning of the
1 27 claimant's benefit year. No calendar quarter in an alternate
1 28 base period shall be used to establish a subsequent benefit
1 29 year.
1 30 EXPLANATION
1 31 This bill amends Code section 96.4, subsection 4,
1 32 concerning unemployment compensation to provide that an
1 33 individual who does not have sufficient qualifying wages to
1 34 qualify for unemployment benefits under the definition of
1 35 "base period" (the period beginning with the first day of the
2 1 five completed calendar quarters immediately preceding the
2 2 first day of an individual's benefit year) can use an
2 3 alternate base period which consists of the individual's four
2 4 most recently completed calendar quarters preceding the first
2 5 day of the individual's benefit year in order to be eligible
2 6 for unemployment benefits.
